Research On The Legal Mechanism Of Ecological Compensation In The Han River Basin

The destruction of the ecological environment of the Han River Basin and its strict river basin governance tasks undertaken in the South-to-North Water Diversion Project determine that the Han River Basin has a deep practical basis for carrying out river basin ecological compensation,and the concept of river basin ecological compensation has become a research hotspot after being introduced into China,in recent years,all places have begun to carry out river basin ecological compensation practice,the legal mechanism of river basin ecological compensation as a necessary supporting measure of river basin ecological compensation,not only plays a guiding role in the development of river basin ecological compensation work,but also can coordinate the interests of relevant subjects in the river basin However,China’s central and local legislation on river basin ecological compensation is relatively lacking,which to a certain extent hinders the active role of river basin ecological compensation in China’s river basin governance,and this paper hopes to play a certain role in promoting the relevant legislation of ecological compensation in the Han River Basin.This paper studies the legal mechanism of ecological compensation in the Han River Basin,first sorts out the research background and its theoretical and practical significance of the legal mechanism of ecological compensation in the Han River Basin,summarizes the research status of the legal mechanism of ecological compensation in the river basin at home and abroad,clarifies the theoretical basis for the construction of the legal mechanism of ecological compensation in the basin,and explains the research methods used in the study.Secondly,the connotation of the legal mechanism of ecological compensation in the river basin and its main contents were discussed.Then,the current situation of the construction of the legal mechanism for ecological compensation in the Han River Basin is summarized,and it is concluded that it is currently facing the dilemma of imperfect legal mechanism system,disconnection between legal mechanism and practice,difficulties in interregional cooperation of legal mechanism,lack of technical construction of legal mechanism,and relevant stakeholders have not been fully integrated into the legal system.Then,the practice of the legal mechanism of ecological compensation in the Xin’an River Basin and the Chishui River Basin in China and the practice of some river basin ecological compensation legal mechanisms in the United States,Australia,Germany,India and Colombia are summarized,in order to summarize the useful experience for the construction of the legal mechanism of ecological compensation in the Han River Basin from these practical cases.Finally,the basic principles of ecological compensation,such as ecological priority,interest coordination,beneficiary compensation,scientific reasonableness,and multi-party participation,which need to be followed in the construction of the legal mechanism for ecological compensation in the Han River Basin,are clarified,and suggestions are put forward on improving the relevant policies and legal system,establishing diversified compensation methods in legal form,strengthening the legal regulation and guarantee of the ecological compensation management system in the Han River Basin,and improving the legal guarantee mechanism for public participation.
