| The river basin horizontal ecological compensation is a kind of system innovation to balance the interest relationship among various subjects in the river basin.It is of great significance to study the legal issues of watershed horizontal ecological compensation in realizing watershed resource allocation.At present,the related laws of river basin horizontal ecological compensation are gradually improving.At the same time,the practice has been carried out in many places and rich experience has been obtained.On the whole,the development trend of cross ecological compensation in Chinese basin is good.However,by combing the current legal and policy status and practice status of horizontal ecological compensation in the basin in recent years,it concludes that some problems need to be improved,such as imperfect legal basis for horizontal ecological compensation in the basin,unreasonable standard setting,single subject and mode,insufficient financial support,and imperfect management guarantee system.Based on the experience of horizontal ecological compensation for basins in foreign countries,the enlightenment on the development of horizontal ecological compensation for basins in China is summarized,and suggestions on legal improvement are put forward,mainly to improve the basic path of horizontal ecological compensation system for basins.Guided by the principle of equal rights and responsibilities,co-construction and sharing,the legal status of horizontal ecological compensation for basins is clearly determined by legislation.The subject and method of horizontal ecological compensation for river basins shall be clarified,the compensation standard shall be set rationally,the funding guarantee for horizontal ecological compensation shall be strengthened,and the supporting system for horizontal ecological compensation shall be improved to provide guarantee for horizontal ecological compensation for river basins and promote the formation of a new pattern of ecological civilization construction. |
