The Research On The Legal Regulation Of The Rural Living Garbage Pollution Treatment

In recent years,with the rapid development of China’s rural economy,rural living garbage quantity also shows a tendency of increase sharply,caused by the lack of effective governance garbage wai village phenomenon not only harm the health of the residents in the countryside,water and soil environment pollution,also hinders the rural residential environment construction work,for the further development of affecting rural revitalization strategy for further implementation.General office of the central committee of the communist party of China in 2018,the State Council general office issued the "rural residential environment improvement action plan for three years,pointed out that to promote the rural living garbage management in one of the important task is to implement the strategy of rejuvenating the country,encouraging rural areas according to the actual,formulate rules for the rural living garbage management regulations,clean local regulations such as rules and regulations to promote the orderly work of governance.In 2021,the first document of the central government,Opinions on Comprehensivly Promoting Rural Revitalization and Accelerating Agricultural and Rural Modernization,also listed rural household waste management as the focus of the five-year action to improve rural living environment.In response to the call to build a livable countryside with a better environment,some rural areas have also carried out standardized exploration of household waste treatment.However,according to the acceptance results of the Ministry of Housing and Urban-Rural Development and other departments,the actual treatment effect often falls short of the expectation,and the current situation of household waste pollution in rural areas is still grim.Admittedly,the causes of the problem are varied,but the root of the problem lies in the imperfect legislative system of rural solid waste,the unclear legal positioning of the government,enterprises and villagers,the imperfect administrative supervision and law enforcement system,and the unscientific setting of the way of assuming legal responsibility.Therefore,this paper selected G County of Henan Province,one of the demonstration counties for the classification and recycling of rural solid waste,as the research target,combined with the field survey results and literature review,starting from the actual problems in rural solid waste treatment and the causes,through sorting out the existing domestic legislation of solid waste pollution treatment,Systematic analysis of existing laws,administrative regulations,departmental rules,local rules and regulations related to rural solid waste pollution control provisions,and at the same time,compared with the domestic waste treatment of foreign countries such as Japan,Germany legislative experience,It is expected to put forward suggestions on the construction of special legislation of rural solid waste,the division of rights and responsibilities of the participating subjects such as the government and villagers,the proper setting of legal responsibilities,and the improvement of supporting legal systems,so as to provide reference for the development of rural solid waste treatment.
