Study On Legal Guarantee Of Eco-environment Collaborative Governance In Yellow River

While the Yellow River is steady,the world is peaceful.To harness the Yellow River,we must protect it and control it.Since the 18 th National Congress of the CPC,the CPC Central Committee attaches great importance to the governance of the Yellow River basin.On September 18,2019,Xi Jinping,from the strategic height of realizing the great rejuvenation of the Chinese nation,he elaborated the fundamental,directional and overall major issues concerning ecological protection and high-quality development of the Yellow River Basin,drew up a major national strategy for ecological protection and high-quality development of the Yellow River Basin,giving the mother River of the Chinese nation a new and more lofty mission.In October 2021,at the forum on Promoting ecological protection and high-quality development of the Yellow River Basin,Xi Jinping stressed that the provinces and regions along the Yellow River should implement the strategic deployment of ecological protection and high-quality development of the Yellow River Basin and unswervingly follow the modernization road of ecological priority and green development.Since April 1,2023,the Yellow River Protection Law of the People’s Republic of China has been officially implemented.The top priority of ecological protection in the Yellow River Basin is to modernize its governance system and capacity in accordance with the law,so that the law can play a leading,regulating,promoting and guaranteeing role in ecological protection and high-quality development in the Yellow River Basin.As an institutional arrangement,collaborative governance emphasizes the integrity and synergy of governance,and vigorously promotes the coordinated governance of the ecological environment in the Yellow River Basin has a profound theoretical foundation,which is an inevitable requirement of collaborative theory and governance theory,and an inevitable requirement for improving the government’s governance capacity.The collaborative governance of the ecological environment in the Y ellow River Basin emphasizes the integrity and synergy of governance,and emphasizes the joint participation of the government and non-governmental subjects,which embodies the principle of green development,promotes the rule of law in governance with "soft law",enhances the collaborative innovation of law enforcement,and promotes the construction of ecological civilization and the construction of a rule-of-law government,and has achieved a series of outstanding results.At present,the ecological protection of the Yellow River Basin in China is facing a series of "difficult decision-making" and "difficult implementation" dilemmas,such as poor cohesion of legal systems,uncoordinated governance goals,insufficient coordination of interests between governance subjects,and imperfect organizational construction of collaborative governance institutions.By analyzing the reasons for the embarrassing situation of coordinated governance in the Yellow River Basin from four dimensions: economic level,subject level,environmental factor level and institutional level,and analyzing and drawing on the experience of advanced river basin and regional collaborative governance at home and abroad,it is pointed out that the improvement path of legal guarantee for coordinated ecological and environmental governance in the Yellow River Basin is: relying on the Yellow River Protection Law,refine the governance objectives and provide guidance for collaborative governance;Persist in putting legislation first,improve basin-wide coordinated legislation and intergovernmental consultation and co-governance legislation;Under the background of the continuous expansion of the scope of collaborative governance,it is inevitable to improve the signing of administrative agreements and management organizational systems of collaborative governance departments and increase the number of collaborative governance institutions.On this basis,explore the establishment of non-governmental coordination mechanisms and build a diversified river basin collaborative governance system.At the same time,strengthen the construction of the ecological environment governance and supervision system in the river basin,improve the environmental law enforcement supervision system and the performance evaluation system of the river basin,so as to promote the ecological protection and high-quality development of the Yellow River Basin.
