Rural revitalization requires industry first.The "Opinions of the Central Committee of the Communist Party of China and the State Council on Doing a Good Job in the Key Work of Comprehensively Promoting Rural Revitalization in 2023"(hereinafter referred to as the "No.1 Document")has been announced,with special emphasis on accelerating the cultivation and development of new industries and formats in the rural service industry,implementing the cultural industry empowerment plan for rural revitalization,implementing high-quality projects for rural leisure tourism,and promoting the upgrading of rural homestays.Rural homestays,as an important part of rural tourism supporting facilities,originated from rural farmhouses and family inns,and have rapidly developed in meeting various unique needs of tourists such as food and accommodation during rural tourism trips.After the release of the epidemic during the Spring Festival holiday,the rural tourism market is booming.Rural homestays not only solve the problem of insufficient accommodation for scenic spots during the peak season,but also become a unique resource for attracting tourists to characteristic tourist attractions such as folk villages,red residences,and scenic spots.The "homestays+scenic spots" complement each other to promote the prosperity and development of the local rural tourism market.The high-quality development of rural homestays is not only conducive to the prosperity of the cultural and tourism market to stimulate consumption,but also to the effective implementation of the current national policy of expanding domestic demand,and to the development of the tertiary industry in areas with good natural and cultural resource endowments to assist in rural revitalization.The continuous deepening of rural revitalization strategy and the popularity of rural tourism have given birth to rural homestays,and the high-quality development of rural homestays is inevitably inseparable from the guarantee of the rule of law.From the perspective of achieving high-quality development of the rural homestay industry on the track of rule of law,this article studies the current industrial development and government supervision status of rural homestays by consulting previous research literature on rural homestays and legal documents on rural homestay supervision published by the Ministry of Culture and Tourism and local government websites.It also conducts on-site research and visits to rural homestay clusters in Guangxi,Jiangxi,Jiangsu,and other places to understand the business situation of homeowners,It has been found that there are mainly problems in the current supervision of rural homestays in China,such as outdated and unsuitable regulatory models,incomplete supporting laws and regulations,lack of management responsibility for tourism network platforms,serious environmental pollution in the surrounding areas,and difficulty in safeguarding the rights of tourism consumers,which affect the healthy development of the rural homestay industry.Deeply understand the characteristics of various stages of the development of emerging industries,analyze the cases of litigation disputes in the development of rural homestay industry,draw on the legal and regulatory experience of the UK,France,and Taiwan region,which are in a mature stage of rural homestay development,and prudently propose innovative regulatory models,scientific and reasonable legislation,sound access and exit mechanisms,construction of tourism circuit courts,and leveraging the role of industry associations,Establish a legal regulatory system suitable for the healthy and stable development of the current rural homestay industry,and achieve high-quality development of China’s rural homestay industry on the track of the rule of law.
