| ObjectivesTo understand the overall situation and characteristics of medical disputes in Gansu Province,to prevent and resolve medical disputes and improve medical services,and to provide scientific reference for medical institutions to prevent and control medical disputes and for health and health administrative departments to develop policies for continuous improvement of medical safety.MethodsThe medical dispute mediation cases received by the Gansu Third Party Medical Dispute People’s Mediation Committee from 2017-2021 were selected as the research object.The research plan was determined by combing the literature related to medical disputes through literature research method,analyzing the causes and influencing factors of disputes,and referring to relevant laws and regulations,statistical yearbooks,and information on the website of the Health and Welfare Commission as the policy reference basis for this study.Through retrospective study,4959 valid cases were obtained,and statistical analysis was conducted on the year of medical disputes,the city of the medical institution involved in the dispute,the gender and age of the patient,the level of the medical institution involved,the treatment department,the medical party’s liability assessment opinion,the settlement method,the claim amount,and the actual compensation amount to understand the overall situation and characteristics of medical disputes in Gansu Province in the past five years,and to propose countermeasures for medical quality improvement.Results(1)From 2017 to 2021,the total number of consultations in Gansu Province was625,172,200,with a total of 4,959 medical disputes registered by the provincial medical investigation committee and a total dispute incidence rate of 0.79/100,000.The dispute incidence rate fluctuated slightly between years,but was basically stable overall,with an average annual decline of 4.07% in dispute incidence.(2)From 2017-2021,medical disputes mainly occurred in secondary and tertiary medical institutions,with the highest number of medical disputes occurring in secondary medical institutions,accounting for 48.72% of the total number of disputes;the highest number of surgical disputes,accounting for 42.41% of the total number of disputes;followed by internal medicine,accounting for 20.61% of the total number of disputes.(3)From 2017-2021,disputes involving male patients accounted for 44.83% of the total number of disputes;disputes involving female patients accounted for 55.17%of the total number of disputes,with a male to female gender ratio of 0.81:1.The highest number of disputes involved patients aged 41 to 60 years old,accounting for33.45% of the total number of disputes.(4)From 2017-2021,82.60% of the total number of medical disputes were settled through third-party mediation;followed by self settlement or withdrawal,accounting for 8.77% of the total number of cases.84.80% of medical disputes took less than 180 days to process,of which 58.22% took less than 30 days to process.(5)From 2017 to 2021,medical disputes were mainly the fault of the medical party,and the total fault rate of the medical party was 69.20%,of which 44.94% was the fault of the medical party’s responsibility;20.89% was the fault of the medical party’s technology.The compensation rate of the medical party was 86.50%;the compensation amount claimed by the patient in medical disputes was mainly concentrated in the range of RMB 10,100,000～50,000,000,accounting for 58.96% of the total number of disputes.2017-2021,the actual compensation amount of the medical party in medical disputes was mainly concentrated in the range of RMB 0.01million～100,000,000,accounting for 62.27% of the total number of disputes.62.27%.Conclusions(1)From 2017 to 2021,the number and incidence of medical disputes in Gansu Province showed a trend of rising and then falling,with the number and incidence of medical disputes decreasing significantly in 2020 and 2021.The city and state with the highest number of medical disputes is Lanzhou City,and the least is Gannan State.The city and state with the highest incidence of medical disputes is Jinchang City,and the lowest is Gannan Prefecture.(2)From 2017-2021,the number of medical disputes and the fault rate of medical disputes in secondary medical institutions in Gansu Province are higher than those in tertiary medical institutions,and the surgical system is the department with high incidence of medical disputes.(3)From 2017 to 2021,the fault rate and compensation rate of medical disputes in Gansu Province showed a trend of first decreasing and then increasing,and the fault rate and compensation rate of medical disputes in 2020 and 2021 increased significantly.The total compensation amount shows a trend of first rising and then falling,and the average starting compensation amount shows a trend of first falling and then rising.Third-party mediation is the main way to deal with medical disputes,and mediation takes the shortest time to close a case. |
