Research On The Current Situation,causes And Countermeasures Of Medical Disputes In China From The Perspective Of Collaborative Governance

In recent years,with the joint efforts of the government,the medical industry and medical personnel,China’s medical technology and the ability of medical personnel have been significantly improved,and the satisfaction of the broad masses of the people with the quality of medical care has also increased year by year.However,due to the unknown and risky characteristics of medicine itself,as well as the increasing contradiction between patient expectations and the limitations of medicine itself,medical disputes often occur.The tension between doctors and patients,and even frequent medical disputes not only make medical staff in a state of panic,but also bring various uneasiness to many patients.In an era of serious shortage of medical resources and backward medical standards,patients and doctors are often able to help each other and jointly overcome the disease.However,with the continuous improvement of medical and health conditions,the tension between doctors and patients has begun to emerge and has now become a hot issue of common concern to the people.The formation of collaborative governance theory is not only closely related to the synergy theory of natural science,but also closely related to the governance theory of social science.It is a new theory formed by the combination of synergy theory and governance theory.In view of the numerous and jumbled fields,matters and contents involved in medical disputes,it is especially weak to rely solely on the power of the government to solve medical disputes.Cooperative governance,as a solution to complex public problems,should be applied to the practice of medical disputes governance.This study attempts to explore the governance of medical disputes from the perspective of collaborative governance.Based on the definition of medical dispute related theories,taking the judgment documents published by "China Judgment Document Network" as a sample,the overall situation of China’s medical disputes is summarized,and the characteristics of the samples are analyzed using NVivo tools to divide China’s medical disputes into medical technology disputes,There are five types of medical management disputes,medical service disputes,patient misunderstanding disputes,and external factor disputes.According to the connotation and characteristics of the theory of collaborative governance,the causes of medical disputes are analyzed from six relevant subjects including the medical and health system,hospitals,medical workers,patients and social media,and third-party mediation subjects,and the medical and health system is improved according to the reasons,Strengthen the construction of hospital management system,improve the technical level and professional quality of medical staff,build a smooth communication mechanism between doctors and patients,report medical disputes in accordance with laws and regulations on social media,improve the third-party mediation linkage mechanism,and optimize the coordination mechanism between various subsystems,etc.In each aspect,the countermeasures to improve the governance of medical disputes in China from the perspective of collaborative governance are proposed.
