| Whether women’s marriage rights are effectively guaranteed is an important indicator of social progress.The Republic of China was a transitional period.Although the law gave women autonomy in marriage,it was still subject to many restrictions in the process of practice.This restriction was particularly evident in the practice of the marriage rights of rural women in Shanxi.After the CPC entered Shanxi Province,it carried out a series of reforms on traditional marriage,making unprecedented progress in the marriage rights of local women.This paper aims to have a comprehensive understanding of the marriage rights of rural women in Shanxi Province in the Republic of China through the analysis of marriage books,archives and periodicals and newspapers of the Republic of China.The first chapter of this article has a relatively objective understanding of the background of the marriage rights of rural women in Shanxi during the Republic of China by investigating the marriage laws and regulations issued by the Beiyang Government and the Nanjing National Government,the women’s liberation movement in Shanxi and the living conditions of rural women in Shanxi.The second chapter studies the marriage rights of rural women in Shanxi during Yan Xishan’s reign in the Jin Dynasty and under the leadership of the Communist Party.Although the right of first marriage and remarriage of rural women in Shanxi Province during Yan Xishan’s reign in the Jin Dynasty has made some progress compared with the traditional period,they still cannot get rid of the influence of traditional marriage.After the outbreak of the Anti-Japanese War,with the establishment of the base areas,the CPC carried out a series of reforms on traditional marriage.The Communist Party of China has guaranteed women’s right to first marriage and the right to remarry to some extent by implementing measures such as limiting the age of marriage,publicity and mobilization.However,there are still some incompleteness in the process of reforming the old marriage.The third chapter focuses on the divorce right of rural women in Shanxi Province during the Republic of China.Compared with the traditional period,women in Shanxi rural areas under Yan Xishan’s governance have greater autonomy in divorce issues,and the divorce rights granted to women by law have also been reflected to some extent,but this progress is relatively limited.Under the leadership of the Communist Party of China,women in rural areas of Shanxi Province have made great progress in the right to divorce,which is reflected in the fact that women have gradually broken through the influence of traditional concepts and achieved marital autonomy.However,under the oppression of the economy and traditional customs at that time,rural women still faced many challenges in the process of practicing their marriage rights.In short,both the marriage reform of Yan Xishan government and the marriage reform of rural women in Shanxi under the leadership of the Communist Party of China have made important contributions to the liberation of Chinese women.However,it is worth noting that the CPC went deep into rural areas and carried out a drastic reform of traditional marriage customs,which made the marriage rights of rural women in Shanxi Province under the leadership of the CPC unprecedented emancipation,which also directly explains the correctness of the women’s marriage policy implemented by the CPC in rural Shanxi Province.However,the CPC encountered many difficulties and challenges in the practice of marriage reform,which also reflected that the transformation of rural customs was not completed overnight,but a slow development process.This is also of great significance for the development of rural areas today. |
