A Report On The Translation Of The Nature Of Legal Interpretation(Chapter Ten)

This report is based on the translation of Chapter Ten ―Deferentialism and Adjudication‖ of the law-related book The Nature of Legal Interpretation: What Jurists Can Learn about Legal Interpretation from Linguistics and Philosophy.Focusing on the theme of legal interpretation,this book mainly discusses the influence of philosophy and linguistics on it.Chapter Ten briefly introduces the viewpoints of originalism,intentionalism,etc.,and makes a detailed interpretation of famous cases from the perspective of deferentialism.Then,the adjudication methodology that can be used for reference is presented in this chapter.According to Katharina Reiss‘ text typology,the original text is an informative text.In the process of translation,the translator summarizes the difficulties of the original text from the lexical,syntactic and textual levels.With the help of Vermeer‘s Skopos theory,the translator chooses appropriate translation techniques to solve the difficulties,and analyzes some examples.At the lexical level,the translator mainly discusses the translation of proper nouns,abstract words,terms and idioms,adopting techniques such as literal translation,transliteration,and conversion of part-of-speech.At the syntactic level,long and complicated sentences,parentheses and passive voice are presented;and methods like splitting-off,reversion,cutting,and voice conversion are frequently used.At the textual level,the translator mainly adopts amplification and combination to achieve cohesion and coherence.In this translation practice,the translator has a deeper understanding of the translation of law-related texts,and classifies the language difficulties of such texts,aiming to provide reference both in theories and practices for rendering the similar texts in the future.
