A Scientific Examination Of Socialist Law In The Context Of The Anti-epidemic

In the context of the fight against the epidemic and with the scientific nature of socialist law as the object of investigation,Mao Zedong proposed that "to engage in constitutional law is to engage in science" and that the scientific nature of socialist law embodies the successful integration of the relationship between law and science.The relationship between law and science has its historical and materialistic basis in the entire history of legal philosophy.The Marxist philosophy of law is based on the materialist-historical view and has developed a correct understanding of the relationship between law and science.The New Crown epidemic has proved to be a major world historical event,with some countries losing ground in the face of the epidemic,bringing deep disaster to their own people and to the people of the world,while China’s success in passing this major test is the result of a combination of legal and scientific resistance to the epidemic.The deep historical significance of this practice is to reveal to us what socialist law is and what the superiority of socialist law really is,but also what bourgeois law is and what its historical limitations are.The practice of resistance to capitalist ideology proves that the law is relatively alienated from science and also reveals,in the opposite direction,a deepening of our understanding of the materialist conception of history.The logic of the Marxist view that the economic base determines the superstructure and that science,as objective knowledge and embodying the absolute nature of truth,is the most fundamental category of the materialist conception of history,necessarily confirms the close relationship between science and law.On the substantive side,science as it relates to the productive life of society is the true foundation and core content of law.As the proletariat and the working class are intrinsically united with science,socialist law has a dual nature,being the will of the people and the will of objective law and science.Based on the principles of the materialist-historical outlook,socialist law can more consciously deal with the relationship with science,better reflect scientific progress in its legislation,more smoothly elevate important scientific conclusions into law,and give equal importance to social and natural sciences,thus further enhancing the scientific nature and superiority of socialist law.
