With the gradually opening-up and development of land market, and the continuous improvement of land market order, the problem of land offenses activity in China become more and more prominent. As a kind of social phenomenon, land offenses activity has its profound social root, which is the result of comprehensive effect of external and subjective reasons. Therefore, to provide theoretical basis and reference for decision making related policies and measures, it is necessary to analyze the different function of social economic terms and its mechanism on land offenses activity from both macro and micro perspectives. In this paper, the hypothesis of Kuznets curve of land offenses activity is proposed and verified based on the analysis of the trend an its regularity changing of land offenses activity in recently years. After setting up a theoretical analysis frame, this paper uses panel data to analysis the interaction of land offenses market players, and the relationship between land offenses activity and its influential factor over1999-2011for31provinces (municipalities and autonomous regions) in China. Then, the realization way to curb illegal land use and maintain the good land market economic order was discussed.Through systematic theoretical discussion and empirical analysis, the following conclusions are made in this paper. First of all, the cost-benefit analysis has important influence on the behavior pattern of land offenses market players. Therefore, the hypothesis of "economic man" and the modern economics theory and analysis method are applicable to the study on land offenses activity. Secondly, protection of victims and law enforcement are mutually improved, which not only reflects the peasants’ weak status in the land offenses market, but also reflects the important role of benign interaction between the government and the society to govern the land offenses activity. Thirdly, it shows by the results of the empirical analysis of the effects of socioeconomic factors on land offenses activity including economic development, industrial structure, urbanization and opening-up, that the phase and mode of economic development plays an important role on the land offenses activity. The extensive mode of economic growth relys largely on the input of various material resources including land resources, which expand demand for land resources and intensify the contradictions and conflicts in the land market. On the back of land offenses activity, it related with the concept of economic development, namely the relationship between fairness and efficiency. Therefore, it’s a reflection of the value orientation with preferential efficiency for a long time in China. Furthermore, the results show that the government intervention has an important effect on land offenses activity based on the empirical analysis of the effects of several system elements on land offenses activity including the strength of government, fiscal decentralization, land finance and the marketization of land market. The government is not only the "referee" but also the "players" in the land offenses market, its adverse effects on the demand for land resources, the allocation of land resources and the land property rights system, is the important cause of land offenses activity.Thus, the main policy implication of this paper is arrived at. The heart of the governance of land offenses activity is to balance the relationship between government and market, modernize China’s governance system and its governance capacity, and speed up the transformation and upgrading of traditional industries. And this is just the core content of the report to the Eighteenth National Congress of the Communist Party of China.
