The Commentary's Addendum On Er Nian Lv Ling Of Zhangjiashan Bamboo Slips And Research On The Relative Problems

About thousands of bamboo slips were excavated in a Western Han tomb numbered 247 in Zhangjiashan of Jianglin County, Hubei Province in 1983. Zhang Jia Shan Han Mu Zhu Jian (No.247) was publicated by Cultural Relics Publishing House in 2001, which includes the whole datas of those bamboo slips.The legal literatures both of Er Nian Lv Ling and Zou Yan Shu are knockout. Er Nian Lv Ling includes the main part of laws in Han Dynasty, is reappearing about laws in Han Dynasty by the numbers which had vanished a long time ago, which provides direct informations for the research on the basic contents, configuration and sequence etc of laws in Han Dynasty. The article from Er Nian Lv Ling was applied in early Western Han Dynasty, which is the epoch both of the beginning about laws in Han Dynasty and the incessant development of laws in Han Dynasty with the requirement from country and society. So Er Nian Lv Ling becomes the indispensable tache when we make a study of the similarities and differences, origin above laws in Han Dynasty and Tang Dynasty, and the self changes about laws in Han Dynasty. The article from Er Nian Lv Ling also relates to all the facets in Western Han society and includes much information of society, polity, economy, military affairs and geography in early Western Han Dynasty, which adds the ample historical materials for the research on society and history in early Western Han Dynasty.Er Nian Lv Ling includes 526 slips, whose length is about 31 centimeter. The letters from bamboo slips are made up of 27 Lv and 1 Ling. Every kind of Lv and Ling have own titles and are copied out from own articles. Er Nian Lv Ling is the whole appellation of those bamboo slips, is the extract of laws in Han Dynasty then and there, the lower limit of years when those laws were copied out is Lv Hou Er Nian (BC.186).On the base of datas from Zhang Jia Shan Han Mu Zhu Jian (No.247), the article makes some addendum by using the infrared photos of those bamboo slips and the conclusion from other researchers. By the analysis to texts of those bamboo slips, the article makes some special discussions above legal and historical problems of Er Nian Lv Ling.The whole dissertation consists of five chapters.The first chapter mainly discusses the text, commentary and syntax. On the base of original photos, text, commentary and the conclusion from other researchers, the article makes some addendums and adjusts some syntaxs according the contexts. For example, there are some questions in the No.232-233 bsmboo slips from Chuan Shi Lv,we get rid of the comma between Shi Ren and Ruo Qian Li,change the pause into the comma in the back of Ruo Qian Li. Another for example, we point out that the sixth letter of the No.229-230 bsmboo slips from Chuan Shi Lv is Xiang according to the infrared photos and the meaning of context.The second chapter makes a bit conjecture above the order of three bamboo slips numbered 90-92 and so on, whose three bamboo slips are separate. But according the inherence of those bamboo slips, we think that their relation is quite consanguineous and can be connected in turn.The third chapter is above the commuting and penalty's increase. Firstly we analyse the basic principles of the commuting and penalty's increase in Ju Lv. And then, the article reviews the situation of the basic principles'appliance and expansion in Er Nian Lv Ling and the judicatory practice in Han Dynasty.The fourth chapter is above the inherited problems on Hu. Except analysing the meaning, implemental ways or principles, the similarities and differences of Fen Hu and Dai Hu, the article make a discussion above two extraordinary examples which are Nv Hu and You Hu.The last chapter encircles mainly the expropriating in Shov Lv. The content concretely includes three questions: the objects that do not need to expropriate when male crime, whether husband is expropriated or not when female crime and the reason why Chengdan and Guixin are juxtaposed with rapists in the precondition of the expropriation.
