At the historical moment of the turn of chiliad, China enters into a new developing stage charactered by completely constructing a wealthy society and boosting the modernization of socialism. It is the historical duty of the current theoreticians to form the new theory to better serve the future practice. Then it is necessary for them to look backward to clear the traditional theory and reconsider the past practice and look forward to abstract and sun up the new practice. Rerrospecting in the study on the reform of rural land institution in the recent twenty years, though it is "booming" and "flourishing", there are many drawbacks in the research methods and analyzing frameworks. Therefore, for China, a developing agricultural country with five thousand agricultural civilization, it is very important to study thoroughly and systematically on the rural land institution and innovate itBased on the summarization and comment on the related research documents, the essay firstly analyzes the historical change of the rural land institutions in China in a long run and puts forward the hypothesis of high-level institution equilibrium trap. Secondly, it constructs a short-term analyzing framework of institution change and goes on comparative static analyses about the historical change of rural land institution in the past fifty years in China. Thirdly, it focuses on the analyzing and evaluating of the "course" and "result" of the reform on the rural land institution in the new era. Finally, it discusses the aim and policy of the reform and construction on the rural land institution in the 21st century and designs the key institution arrangement of 21st century rural land institution on the view of laws.The main achievements of the essay are as follows:1. It puts forward and proves the hypothesis of high-level institution equilibrium trap. At the beginning of the Chinese agricultural civilization, the "imperial power", as the institution supplier, under the low productivity in originality society, constantly and jumpily offers the "modernity" arrangement of land institution and as a result, the landlord land private system is established in China more than two thousand years earlier than in western world. Thus, China obtains great economic achievements and advanced science & technology due to the overwhelming institutional comparative advantages and she has arrived the gate to the wholly industrial and technological revolution till 14' century. However, from then on, the "imperial power", as the institution supplier, owed to its own historical limitation, does not put the traditional land private system into modernization under the comparative high productivity conditions and the land institutions are in a long run equilibrium. Furthermore, the land annex law contained in the traditional land private system counteracts the development of China economy. Therefore, the main technology factor that generates the Britain Industry Innovation in the 18th has existed in China in the 14th century but the Industry revolution does not break through in China.2-During the two-thousand-year history of feudalism in China since Ch'in Han period, the "imperial power" brings forth the land private system firstly. And then it becomes the biggest barrier for the flux of the traditional land private system to the modern land private system and the feudalism in China governed by the imperial power does not move out from the high-level institution equilibrium trap. When it rums to the 20th century, in order to prompt China to move out from the high-level institutional equilibrium trap and realize the change from agricultural civilization to industrial civilization, Chinese advanced people represented by Kuomintang and Communist Party carries on two times164historical innovation practices with quite different objects.3.
