Cepa Legal Issues Studied

After the World War II, the freedom of multi-lateral trade has been going side by side with regional trade integration, which has become an irreversible trend in today's economy developing. In recent years, WTO negotiation went on with great difficulties in Doha and even suffered frustrations in Cancun conference, which has quickened global economic cooperation within regions. Regional trade agreement has become an important form for international economy cooperation. The form is that two or more than two countries and regions within an area, through the various ways of Prior Trade Arrangement, Free Trade Area, Customs Union, Common Market, etc., realize the aim of free trading within an area. Up to 2, 2005, the trade agreements within areas reported to GATT/WTO has amounted to 312, most of the economic organizations within areas were formed after the formation of WTO. Every country in the world joins in the regional economy integration mostly for reasons of politics, economy, legislation and some other reasons. China has getting on well with its economy after joined in WYO. Under the circumstances that regional trade integration has become a trend in international economy developing, China is exploring arranging for becoming a part of it. In 1991, China joined formally in AA economy cooperation organization; since the founding of Shanghai cooperation,China has been taking a part in it; on the 4th, 11 , 2002, China——leader of ASEAN,signed "China—ASEAN all-out Economic Cooperation Frame Agreement" in Phnom Penh Cambodia, which marks the formal starting of the course of making China——ASEAN free trade region. The signing of "Closer Economic PartnershipArrangement"(CEPT) in 6, 29, 2003 is a genuine practice or China's participating in regional trade integration. It is appraised that CEPA is China's coming on all sides into rehearsal for the real battle, as well as a starting point to construct an area within regions of Inland, Hong Kong, Macao and Taiwan.
