Nation is the main factor for maintaining social order by its compulsory public power. With the nation's coming into being, the police power has infiltrated into every section of human lives and has an extensive connection with civil rights. On one side the function of police power to maintaining public order is contradict with individual rights, which would have the influence on private civil rights and freedom, and it will prevent against the intervention of police power. On the other side the accomplishment of private civil rights and people's freedom would relay on favorable social order and the respect to people's right. Thus the relationships between the civil right and the police power become complex and under such situation the contradiction and the conflict cannot be avoided. These conflicts will reveal lots of problems such as the adjustment and regulation of the police power and the relationship among private civil rights etc., which need people's attention and settlement.The aim of the dissertation is to rethink, to make analysis, and to solve these problems of police power. This dissertation does not study the topic from the perspective of internal police functions'partition and its competence but focus on the general power of public security organs, the distinction between official authorizations'function and social organizations', and the existent problems of police power in China in order to find out the reasons, regulation strategies and the settlements.The dissertation consists four parts apart from the preface and the conclusion.
