| The study of Zhang Ju (chapters and sentences) of Lv (code) in Han Dynasty, refers to the academic activity that the Lv experts in the Han Dynasty employ the annotative methods used in the study of Confucian canons to annotate the laws and regulations, consequently, the annotation of the Zhang Ju of Lv has legal binding force and can be regarded as parts of legal system. Therefore, the study of Zhang Ju of Lv is not only the important research object for history of legal science in the Han Dynasty, but also the new task for the research of legal history in Han Dynasty. This thesis discusses and develops this issue from these two perspectives so that we can solve some of those academic problems. The thesis can be divided into the next following five chapters:Chapter one: IntroductionIn this chapter, the author makes clear the purpose and theme from the very beginning concerning the next following three viewpoints.Firstly, the concept of the study of Zhang Ju of Lv and the academic characteristics of it will be described here. In the Han Dynasty, a lot of scholars study this subject, they have regular and commonly-used academic principles and methodology, and they write a great amount of representative academic works. Thus the achievements---Zhang Ju of Lv, has been implemented in the judicial practice. From the above-mentioned four features, the author discusses the academic activities which concerns about the annotation of Lv and other legal regulations, and believes that this kind of activity should be regarded as the "study of Zhang Ju of Lv', so that the phase characteristic of Han Dynasty in the process of ancient legal science can be revealed here. Whenever people see "Zhang Ju of Lv", they will know Zhang Ju of Lv is part of legal system in Han Dynasty; whenever people see "the study of Zhang Ju of Lv', they will know it is the academic form of legal science in the Han Dynasty, so that it can be distinguished from the study of Lv and Ling (legal ordinance), the study of the nomination of Xing, and the study of Lv afterwards. |
