It leads to IPR crime (crime of intellectual property right) more grave and its criminal act more fierce owing to weakly reprimand and high profit caused by infringement and criminal act of intellectual property right, and such loses are hard to measure and counted by money. All efforts to construct perfect protective system of IPR, to safeguard fruits of IPR intact and to promote use of fruits of IPR have already become functional base of IPR and the bridge between China's economies to world. The legal protective system of IPR in China is the unity of inter-independent and inter-related contents among civil protection, economic law protection, administrative protection, criminal protection and so on. Among them, although it is lagged behind for theories and practices of criminal protection of IPR in China, it has initially set up protective system of criminal law for IPR which shows a certain standard and apply with China's condition.This article, just from the perspective of researcher of criminal law, tries to construct perfect legal system of IPR protection and to probe into deserved contribution and role of criminal law under background of intellectual economy. Surely, many ideas aim to bring out and rethink problems, and take more profound questions of others as author's terminative aim.The crime of IPR refers to acts that break regulation of law of IPR, infringe others'IPR in grave level and should bear criminal liabilities. Crime of IPR includes the following characteristics: firstly, the same objects of crimes infringed are legal interests of IPR owners and regulation system of IPR.
