A Study Of The Changes And The Legal Protection Of Copyright In Information Era

This paper systematically discusses the changes and the legal protection of copyright in information era. From the view of historical development, with uniting theory with practice, taking the ways of comparative analysis and case analysis, and also considering the methods of positive analysis and dialectical analysis, we have reviewed and researched the historical evolution of copyright law quite roundly and concretely, especially the copyright law's new changes, evolvements, reforms and developments under the condition of the latest network technology. In home and abroad especially within international organizations and international conventions, we also study the legal system of copyright protection, relevant regulations, characteristics and its influences, and its basic orientation and developing tendency. Based on copyright institutional legal principle, considering economy and innovative value, we put forward some suggestion about improving and perfecting the system of copyright protection. The paper expounds general theoretic issues coming from copyright expansion in information era such as deepening connotation and widening extension of copyright, variety of objects, complexity and changeability of contents, and transformation of copyright's power and function, etc; It also appraises and analyses some topics of general interest such as"temporary copy","exhaustion of distribution right for one time","safe harbor rule", knowledge sharing system, etc. We focus the society protection and self-protection of distribution right and copyright in information networks, and make amply introduction and appraisement of these protections on many sides as legislation, judicature, administration, collectivity management, etc. Under the industrializing development of copyright and other intellectual property, to counter more and more impacts on innovations and progresses of society in politics, economy, and culture, along with upgrade of copyright's position and increasing difficulty of copyright protection, we raise that legal system of copyright protection also needs to be both improved and innovated.
