The Changing Of Knowledge And Social Contexts

As a sociological research of knowledge, this dissertation mainly dealt with the knowledge's case of sociology of law, which is a sub-discipline between jurisprudence and sociology. With sociology paradigm as basic structure, the paper generally focuses on the explanation of the knowledge's evolution of sociology of law ever since China's reform and opening period. Through the evolution we can have a taste of the social context of knowledge behind the knowledge's statement.The researchers who study sociology of law are knowledge producers of sociology of law, whom can be divided into two groups, the community of sociology of law researcher and the other researcher. Different types of researchers have different approaches to research of sociology of law, and each possesses different social role respectively. More important is that the researcher's structure of sociology of law has determined what the knowledge of sociology of law would be. The production of the knowledge related to sociology of law not only connected with the knowledge's of producer, but also connected with the social field. The knowledge's production process of sociology of law is the process that producer has reflexive construct in social field. It is the very social field which constructed the structure of community of sociology of law, and it also constructed the knowledge's feature and the body of sociology of law in China.Since 1980's, researcher's ideas had transformed from Tradition-Modernization approach to "State-Society" Frame, further to Plural Frame. The changing process of researcher's ideas represents the logic of social transformation and the essence of social development. Since reform and opening, China begins to pays great attention to construct national legal system, then gradually downward to fix on social fork law order and absorb it, in order to integrate the national order and the folk order reasonably. When national institution has been constructed, the rule by law has experienced from the political legalization to the legal legalization and again to the social legalization. Contrary to this, the folk order's legalization had transferred from the social validity to the political validity then to the legal legalization. This is the mutual-constructive process of national order and folk order in Chinese social field.During the evolution of sociology of law knowledge in China, the knowledge function of sociology of law and the social role of researcher had also changed. This is the result of Chinese social transforming and changing, it also put forward the new chance to construct new paradigms in the sociology of law in China.
