The dissertation summarizes and analyzes the right and power to accept education and the controversial movement between the right to access to education and the right to educate under Marxist principle with the paradigm's method from the angle of philosophy, law philosophy and history which derivates five types of subject paradigm, eg. the paradigm of privilegization, religiousization , nationalization, socialization and characterization to right to access to education. This states that the paradigm of right to be educated is changing with the development of human history. At the same time, the social function of education get into the central place in society which is getting the motive power of social development. This dissertation also concretely analyzes the different function of power subject and right subject to be educated, because of their interation, the paradigm of right to be educated form its features. Macro model of right to be educated is extracted by the analyses of secure systems and administrative systems which is intended to lay the foundation of law philosophy and social history direction on the right to be educated. This dissertation puts forward suggestions on policy and law of China education from the view of theory and practice.
