In order to control the market, acquire monopoly profit, and avoid competition, enterprises have the motive of forming cartels. Lured by monopoly profit, the conspiracy activities among enterprises will surpass national boundaries. Although many countries treat cartel activities as per se illegal, in the international area, some countries have no anti-trust law at all; some countries have anti-trust law but have no specific provision for the punishment against international cartels; some countries have specific provision to punish international cartels but need other countries' cooperation when making investigation or taking anti-cartel enforcement. Especially when involved with national interest, the punishment against international cartels gets more difficult. As the globalization of economy, the international trade and relation develop very quickly, and the influence area of international cartels becomes wider and more complicate. In order to improve global welfare, it's quite important and desiderata to establish the effective deterrence mechanism against international cartels.The competition policies against international cartels nowadays seem very thin and weak, and the limited competition policies always have many problems and obstacles when brings into effect. These all becomes the bottleneck of effective deterrence, bothering many competition authorities. Facing the international cartels problems, every country always think first about the interests of their own, so it's not surprising to appear the "begger-thy-neighbour" export cartel exemption problem. When coming down to national interests, each country will claim its extraterritoriality, so as to avoid conflict with other countries. Such conflicts have greatly influenced the investigation, litigation, judgment and punishment against international cartels. Each country will always investigate and punish other countries' cartel members actively, and protect its own enterprises.
