Agricuiture Intelligent Property Right Management Countermeasure After The Accession Of WTO

Since China joined WTO( WTO) and relevant international intelligent property rights organizes with the convention, the duty concerning relevant provision of protecting intelligent property right of WTO must be carried out, it is same in China agriculture realm. However, agriculture intelligent property right is a newly arisen business to most China science and technology researchers and managers, the related theories and study just began to start, and still hasn't established a system of theory and analysis method in agriculture intelligent property right management domestically currently. Try to using management, policy and relative theory to analysis China agriculture IPR management mechanism, strategy and countermeasure and measure, putting forward thoughts and methods point in enforcement of agriculture intelligent property right management for those of government, enterprise, S&T research institute and academy is the main contains of this dissertation. Total dissertation is consisted of 8 chaptersPart one: background of China agriculture IPR management after accession of WTO. It is the initial point of this dissertation, mainly speak of the chance and challenge on china agriculture technology development and the necessary and urgently for china to conduct agriculture IPR management.Part two: The theory foundation of agriculture IPR Protection. This part is fundament base of full dissertation, putting TRIPS of WTO to be the main discuss point, the connotation of agriculture IPR was discussed, putting forward the protective point in intelligent property right in agriculture realm and designed synthesized evaluation index of agriculture intelligent property right.Part three: Mechanism of Agriculture IPR Protective management. it is the main contents of the dissertation. Firstly, expatiated the management system of agriculture intelligent property right protection in agriculture from administration system and law system, then joined the government, enterprise and institution to analyze the agriculture IPR protective Operation mechanism.Part four: IPR protection of important domain in agriculture technology after joined WTO. The new species breeds in plant, agro-biological technique patent protection, andprotection of original production place of agriculture products were the important domain of agriculture IPR protection after joined WTO. In the same time, management system, operation system and empirical experiment were analyzed systemically.Part five: the status quo of China agriculture IPR Protection. the status quo of new species breeds IPR protection in plant, agro-biological technique patent IPR protection, and IPR protection of original production place of agriculture products and IPR protection of agriculture new and high technology results were introduced, and the main problems of IPR protection existed in the three domain was analyzed currently.Part six: Case study of IPR protection in agriculture institute and enterprise.
