Entering the end of 20 century and the beginning of 21 century, on the basis of the practice of deregulation about 30 years long, aiming at improving the quality of government regulation, the regulatory reforms became the worldwide new generation tide of reform. Arousing the whole world attentions, the regulatory reforms have made better performances. Therefore, the problem of the quality of government regulation has become the researching topic of economics, law and public management.Concerning the research on the problem of regulatory quality, it is much concentrated in the policy analyses about how promote the regulatory quality of countries which are carrying out regulatory reform and their questing for realizing tools and means. On the theory research of the problem of regulatory quality, there have been not only few productions, but also the characteristic that theories research gets behind with the development of regulatory practices. The thesis tries to build the theory system of regulatory quality, makes deeply the economic analysis to regulatory quality and explains the academic essence and characteristic about regulatory quality. Use the theory of regulatory quality to guide the practice of Chinese regulatory reform in transition era. Besides the introduction, the thesis is divided into four chapters:Chapter 1: Literature Overview of the Problem on the Quality of Government Regulation. The thesis tries to sum up the correlative theories of regulatory quality from two aspects: one is explaining the theories about background and origin of the rise of regulatory quality; the other is an overview of basic theories and academic research status of regulatory quality. Using the market failures theories, government failures theories, regulatory life cycle theories, regulatory governance theories and total quality management theories, the thesis discusses that the rise of the research on the problem of regulatory quality is the result of regulation adapted to times changing and the need of innovation, also is the result of the development and enlightenment of many correlative subjects and theories. Nowadays, the problem of regulatory quality is the most front for regulatory reform in the whole world. The summarization of basic theories and academic research status of regulatory quality mainly includes the following three parts. Firstly, from the international organizations, governments and academic scholars'perspective, the thesis expounds the basic cognition and understanding about regulatory quality, based on the research, and puts forward the concept of regulatory quality. Secondly, describe by system the principles of existing regulatory quality. Thirdly, analyze and appraise the research status of regulatory quality, also do some expectations on future development.Chapter 2: The Economic Analysis of Regulatory Quality. The absence of regulatory quality theories has become the obstacle for innovation and practice of regulatory reform in many countries. Need the scientific and systemic theories of regulatory quality to solve many puzzles of thoughts and practices. This chapter especially emphasizes the economics analysis of the problem of regulatory quality, and clarifies several basic theories and concepts. Taking the regulatory institution variance as background, the thesis explains the academic essence and characteristic about the improvement of the quality of government regulation. Exploring and considering principles of the quality or performance of government regulation, the thesis brings forward the criterion of perfecting the regulatory quality evaluation indexes.Chapter 3: Comparative Analysis with Practices and Experiences of Typical Countries Promoting Regulatory Quality. Based on the special polity, economy, culture and history background, each country's the experiences and policies have characteristics as a necessity. If we eliminate the specific factors, such as national difference, it appears that regulatory reform in nowadays have the common rules and trends. For the reform of regulatory quality in China, those rules and trends have revelatory and referenced effects. During the period of learning, we shouldn't totally emulate and must be cautious to treat regulatory policy transfer. Drawing lessons from comprehensive and mature policy experiences, and we have to consider our national concrete state in the meantime. According those, this chapter puts forward regulatory policy transfer of transition countries needing to resolve several understanding problem on theories. Selecting three representative countries: The Unite States (west developed country which has mature regulatory system), Korea (following developed country in Southeast Asia), Russia (typical economic transition country), the thesis generalizes and compares their experiences on promoting regulatory quality. In the end, the paper clarifies referenced meanings. Chapter 4: Improving Regulatory Quality for China in Transition Era. First, under the transition background, analyze the characters of government regulation and state of regulatory quality. Due to the special characters of society and economy in transition era, regulation in the transition countries whose regulatory quality is at low level presents inherent characters, such as heavy roles, not easy to confirm boundary and so on. Second, describing the process of regulatory reform in China, the thesis includes and analyzes the content of regulatory reform on improving regulatory quality. Finally, learning from the international advanced experiences, integrating with the actual existence of regulatory quality in transition era and illuminating the especial signification of improving the regulatory quality in China, the thesis sets out policy advices about improving and promoting the quality of government regulation in China.Main innovation of thesis:Firstly, on account of the novel topic and angle of view, this research has been innovational meaning. The research on the quality of government regulation is the newest problem of government regulation theories in the world. There are fewer researches on this topic, especially in our country's learning domain. This thesis reflects the newest direction of government regulating economics in nowadays. During the economics analysis of the problem of the quality of government regulation, this thesis clarifies several basic theories and concepts. Concerning the research on the problem of the quality of government regulation, it is much concentrated in the policy analyses about how to promote the regulatory quality of countries which are carrying out regulatory reform and their questing for realizing tools and means. There are less of criterion analyses of regulatory quality, and is short of general literature overview. The thesis tries to sum up the correlative theories of regulatory quality from two aspects: one is explaining the theory on background and origin of the rise of regulatory quality; the other is an overview of basic theories and academic research status of regulatory quality. The author concludes basic theories and recent researching production from tremendous amount of literatures and data. Those researches build the rich literature foundation for the study of this thesis, and also create basic conditions for academe and practical department to research later.Thirdly, during the analysis with practices of improving regulatory quality in The Unite States, the thesis puts forward the theory viewpoint about establishing and perfecting" regulating supervisor bodies". The most distinct character of American practices is building the Office of Management and Budget(OMB)to regulate and supervise the regulators. The author calls it as "regulating supervisor bodies". OMB differs from ordinary regulators which are in charge of making and implementing regulation for some industries or fields. Because it is set up in the Whitehouse office which is the highest policy level, OMB has several special statuses which help to regulate regulators and efficacies on regulating supervisors. The thesis does some theory analysis on special status and efficacy of "regulating supervisor bodies". According those, put forward constructive advices for building "regulating supervisor bodies" in China, which have very important reference value in making policy.Fourthly, the thesis deeply analyzes the problem of regulatory policy transfer in transition countries. Aiming at improving the quality of government regulation in west developed countries; the regulatory reforms have made better performances of society and economy which arouse the whole world attentions. They sum up a set of comparatively perfect polices on improving regulatory quality. The international organizations such as The World Bank and the Organisation for Economic Co-operation and Development press transition countries to adopt regulatory policies on improving regulatory quality. So how to treat regulatory policy transfer for transition countries is very important practice and theory problem. Put forward regulatory policy transfer of transition countries needing to resolve several understanding problem on theories. On account of the differences between transition countries and developed counties on market, institution and law surroundings, it's necessary to cautiously treat the problem of regulatory policy transfer for transition countries. Combining own characters, transition countries need implement regulatory policy transfer properly. This requests learning and not total emulation.
