Study On The Implicit Demand Of Building Construction Contract

In view of the professional, technical, complexity and other characteristics of theconstruction product, cause the owner can not integrity and clearly express its demandof the project,especially the special demand, at the same time, make it difficult forcontractors to accurately understand the real demand of owner. Therefore, how toscientifically and objectively identify the demand of owners, especially some implicitdemand to reduce engineering change, to avoid or reduce the construction contractchange, thereby controlling the construction contract risks, is currently the focus of thestudy.In this study, the author analyze and summarize the fact "construction contract existof implicit demand" from the construction project contract management practical, putforward the implicit demand is one of the important factors that lead to the contractdispute and the discovery and control of implicit demands is one of the key ways toincrease management efficiency. On this basis, expand construction contract implicitdemand in-depth study.First, applied systems analysis technology, based on incomplete contract theoryproves the existence of the contract implicit demand and propose four related issues.From the perspective of human cognition and expressions use "think","say","write"three dimensions to separate the contract implicit demand from the contract demandpattern spatial distribution of many kinds of different performance pattern and theclassification. And other issues.This study introduce the implicit demand into the construction contract managementis a bold challenge, which integrate a variety of theoretical and methodological toexplore a new space and reveal the relevant rules of construction contract,which hascertain theoretical significance. Research has revealed that the implicit demand is a largeobstacles or an incentive to the construction contract. Therefore, scientifically recognizeand excavate the implicit demand of the owners is of great practical significance,whichis good for both the owners, and the contractors, their economic interests, as well as therelations between the two sides, and even create industry harmonious atmosphere.
