Research On The Construction Of The China Juvenile Justice System

The United States is the birthplace of the juvenile justice system. After a century of development, the United States has formed a relatively comprehensive juvenile justice system. In our country, the ideas about the juvenile justice emerged at a very early time, but we have not established a modern juvenile justice system so far.This article aims to draw lessons from the excellent experience in the construction of the juvenile justice system in the United States and provide some ideas for the construction of the juvenile justice system of our country. With the juvenile justice system, we can provide protection for the rights of children, decrease and prevent children crime.The main topics of this article are the theory and characteristics of the juvenile justice system in the United States, how to draw lessons form the experience of the United States, and the way to construct the juvenile justice system of our country. This article is divided into four chapters.ChapterⅠincludes two sections. The first section discusses the denomination of the juvenile period and its age range. The author uses the words“children”and“juvenile”to stand for the juvenile period. The upper limit of the age range is eighteen years old. The second section discusses the concept and characteristics of the justice, the judicial authority and the justice system firstly. Based on them, the author investigates the features and meanings of the juvenile justice system to introduce the concept of the juvenile justice system. Then, the author analyzes the main ideas about the concept of the juvenile justice system and proposes the author’s idea. In the author’s opinion, the juvenile justice system is the substance, procedures and rules that are made according to the mental and physiological feathers of the juvenile, with the foundation of protecting the children, and is a special justice system independent of the adult justice system for the judgments of the cases about the children crime, the children welfare, and the children rights. This chapter is the fundamental part of the article, and the following chapters are based on it.ChapterⅡsummarizes the theory and characteristics of the juvenile justice system in the United States and describes the theories and experience that we may learn from.ChapterⅢsummarizes the development of the juvenile justice system in our country in detail and introduces and reviews the past and present situations of the juvenile justice in China. Also, it analyzes the current situation of the juvenile justice system in our country and points out some problems.ChapterⅣis the main body of this article. Based on the contents of the prior chapters, it focuses on the ideas for the construction of the juvenile justice system of China, and some related recommendations are proposed.
