A Study On Juvenile Protection System In China

Since the first juvenile court was established in Illinois in1899, juvenile justice system has been over one hundred years of development. Juvenile justice system has become an important symbol of a country under the rule of law process. Protection measures system is an important part of the juvenile justice system and become the world place in the pattern of criminal teenagers. But in the juvenile justice system of our country, there no protection measures system. The juvenile justice system in our country is still juvenile criminal justice system, and the main treatment measures for juvenile crime are based penalty for dominance. Meanwhile, some of the youth of serious misconduct have been marginalized by the juvenile justice system in our country. In short, the color of the juvenile justice system in our country is too thick, lack of welfare. If our juvenile system should get rid of the plight of development at present, protection punishment system provides a good choice. This article through the study of juvenile protection system, including origins of the juvenile protection system, content and other aspects, on the basis of analysis of the plight faced by the juvenile justice system on our current, and try to build a juvenile protection system which is in accordance with the situation of our country.This article is divided into four chapters. The first chapter mainly discusses the origin of the juvenile protective punishment, theoretical foundation, the concept, species, and reveals the nature of the juvenile protective punishment from four aspects including objects, the judicial organization.The second chapter analyzes and illustrates the necessity of the construction of juvenile protective punishment system in China from the concept and the current status of the juvenile justice system in our country.The third chapter mainly demonstrates the feasibility of the construction of juvenile protection disposition system in China. From the theoretical basis of whether there have built to juvenile protective punishment system, conditions, and juvenile justice practice is to provide a favorable draw and on other aspects of the analysis.The fourth chapter bases on the Chinese national condition and the comparative study of foreign related system to build the juvenile protective punishment system of our country. First of all, the juvenile protective measures system should be constructed. Secondly the disciplinary details of the protective punishment system should be designed as well, including trial principles, trial procedures, etc.
