Research Of Administrative Regulations Of Natural Monopolies In China

Since the1980s, China has being put itself into the trend of deregulation in natural monopoly industry. However, regulation reform on natural monopoly hasn’t got an ideal effect, due to the deep influence of the planning economy system and the incompletion of the law of marketing economy system. Especially, the awkward situation of mixing up the functions of the government and enterprises seriously affects the development of the reformation. In the process of Construction of socialist rule of law, it is become an urgent problem to put natural monopoly under the supervision of administrative law. So the purpose of this paper is to find an effective way to complete administrative law in the aspect of supervising natural monopoly industries, so that they can grow and develop in a healthy and efficient way.This current study analyzes the reasons for the fail of reformation in natural monopoly industries, and constructs the system of administrative law. It mainly includes:introduction, current law situation, researches in and abroad, significance of the study, and approaches of the study.Chapter Ⅰ offers a review of the terms and theories about natural monopoly and administrative law in natural monopoly industries, and then interprets the relationship between the two, analyzes reasons for the fail of the current administrative law, which the following chapter will discuss.Chapter Ⅱ discusses regulations on market access, the reasons for its appearance, proposes some specific strategies for regulations on market access, and focus on exploring Administrative franchise as one of the regulations.In the clued of internal regulation, Chapter Ⅲ focuses on regulation on the quality and prices, consisting significance of quality and prices regulation, advance experiences from developed countries, and proposing ways for our own quality and prices regulation system, then, this part introduces some other internal regulations, such as structure, network, and investment. Finally, the paper does some relevant law studies on administrative contract (one of the most commonly used way in the study of internal regulation) to complete internal regulation so that it can be more effective in the natural monopoly industries.Chapter Ⅳ is about external regulation, concentrating on administrative monopoly. By presenting the existing forms of administrative monopoly, causes for it and the current situation on regulations, the study proposes ways like building an independent regulatory system to prevent administrative monopoly, which leads to a discussion and exploration on regulations structure.And the last part chapter Ⅴ takes the electric power industry as an example. Firstly, it presents current regulatory situation on electric power industry and its inefficiency. Then, it analyzes those problems in the regulation system presented in chapter4so as to prove the possibility of administrative regulatory system in natural monopoly industries.
