Study On Judicial Problems Of CH’IN Dynasty

This paper try to research some specific problemss about CH’IN’s judiciary in multi-angle, especially thoese brought out by new found literature unearthed, based on the researchs which made by scholors, and the newly published<CH’IN’s slip texts of liye(V.1)> and<CH’IN’s slip texts of yuelu academy(V.3)>.The first chapter of the "the formation and congtinue of CH’IN’s judicial traditions" concluded the influence from historical and racial instruments and Warring States’theories to CH’IN’s judicial traditions, analysed some materials from bronze inscriptions for the reserchs.The second chapter "CH’IN’s Grassroots judicial officers"discusses the case of proceedings part of the prison-"Gao He". Concluded that:"Gao" and "He" the essential difference between its personal and official nature of the differences and whether the requirements of the resulting difference in demand for writing. It is noteworthy that the underlying public office, such as QiuDao, TingZhang and LiDian, etc.,can’t make the "He", but only likethe ordinary people to"Gao";Explanation of Chapter III of the "analysis of CH’IN’s local judicial cases " in the confusing "YouJu" issue, saying that "YouJu" is "JuYu," a special link in this session, officials have identified need to conviction and sentencing trial and began the investigation and before the final confirmation;Chapter IV "analysis of CH’IN’s local judicial archives"attempt to resolve the "Fu" and "FuWen" the two then the problem of understanding the legal language used. Concludes:"Fu" mainly refers to GaoHe later included in "FuYu/ZhiYu", the principal fact-finding session, but sometimes can be broadly alleged that the "FuYu/ZhiYu" stage.
