| Chapter 1 introduces the concepts of consolidated arbitration and concurrent hearings, and distinguishes similar concepts, and then shows the development history of consolidated arbitration and concurrent hearings.Chapter 2 analyses the advantages and traps of consolidated arbitration and concurrent hearings. The advantages include avoiding inconsistent arbitration awards, keeping justness, saving arbitral resource, improving arbitral efficiency and so on. The main traps are violating parties autonomy of will, breaking rule of privacy and being blocked by The New York Convention.Chapter 3 discusses arbitral rules and laws of different countries or arbitration institutions, which regulate consolidated arbitration and concurrent hearings, to study and compare the ones of China. And there is a finding that as to the regulations about consolidated arbitration and concurrent hearings, it’s blank in the relevent laws, and the arbitral rules that regulate consolidated arbitration and concurrent hearings are not perfect, and need to be improved.Chapter 4 studies the design of rules of consolidated arbitration and concurrent hearings, starting from the conditions that consolidated arbitration and concurrent hearings can be used, the right of decision of consolidated arbitration and concurrent hearings, the appointment of arbitrators, the making of arbitration awards, and the interaction of consolidated arbitration and concurrent hearings with another systems to design the system.Chapter 5 studies the coordination of consolidated arbitration and concurrent hearings and Chinese arbitration laws. Firstly, this paper analyses the difficulties that consolidated arbitration and concurrent hearings face under Chinese arbitration laws. These difficulties include lacking legal basis, hard to make sure the range of cases that can be consolidated and concurrent heard, hard to appoint arbitrators and the arbitration awards can not be easily confirmed and performed. And then, by learning the experiences from different countries this paper is going todesign the corresponding resolutions to fix the difficulties. |
