A Research On The Objectives Of And Approaches To Achieving The Rule Of Law In China’s Local Governments

The Fourth Plenary Session of the 18 th CPC Central Committee has passed the “ Decisions on Major Issues Concerning Overall Promotion the Rule of Law “. The Decisions has proposed the target of building the Rule of Law in China. The Rule of Law in China can be built by the integration of the country under the rule of law, government by law and society with rule of law and the combination of ruling the country in line with law, governing by law and administering based on law. Promoting the rule of law in local governments and building a government under the rule of law is the vital key to promoting the integration of building the country under the rule of law, government by law and society with rule of law and implementing the combination of ruling the country in line with law, governing by law and administering based on law to construct the Rule of Law in China This paper mainly studies the issues of targets and paths of the riling of law in local governments. This paper is divided into five chapters in the structure. The first chapter is an overview of ruling of law in local governments, mainly elaborating some basic concepts and basic theories, including the rule of law and the ruling of law: the government, local government and the role of local government; law-abiding government, the country under the rule of law, and society with rule of law; ruling the country in line with law, governing by law and administering based on law, mainly the concepts which will be involved in the writing and analysis of the paper.The second chapter deals with the legalization course and inspection in both the Chinese and western governments mainly reviewing and summarizing the course of government legalization from the pre-end of Qing Dynasty to the end of Qing Dynasty to the pre-founding of new China to the founding of new China and briefly reviewing and summarizing the course of government legalization in UK, the United States, France, Germany and other countries to draw on the experience that we can rely on to promote the course of local government legalization today.The third chapter is about the status quo, achievements, difficulties in practice and analysis of reasons in local government legalization in China, mainly summarizing the achievements that our country local government of rule of law has made since the reform and opening up to the outside world(which becomes realistic basis for further ruling of law in our local governments) and analyzing the existing problems in promoting local government of rule of law and the reasons for these problems.The fourth chapter deals with objective of Chinese local governments under the rule of law: to establish a government ruled by law and to specify the objective building the government under the rule of law into the government administering according to law, limited government, responsible government, honest government, clean government and service-oriented government.The fifth chapter is about the selection of approaches of the Chinese local government under the rule of law, mainly to analyze collaboratively the dynamic mechanism of local governments under the rule of law from the “Down-press” of the ruling party and the central government and the “Up-push” of social public and the collaboration of all levels of local governments, to analyze the procedural mechanism of local governments under the rule of law from the local government subject’s self-discipline, social subjects’ participation and governmental and social interaction and to analyze the concrete realizing paths of local governments under the rule of law from the updating of concept(law supremacy, people-orientation, standard of right and fair justice), institutional innovation(relations between the party and the government, relations between the central and the local, and the administration of officials and rule of law), and the construction of civil society.Finally, in a brief conclusion, this article believes that the ultimate goal of promoting the local government under the rule of law is to build a government ruled by law, and it is a process, and it is a systematic project in need of work from all aspects.
