Research On System Of Economic Law Of Shaanxi-Gansu-Ningxia Border Area

Shaanxi-Gansu-Ningxia Border Area has great importance in the history of Chinese Communist Party(CPC).During this period,combining the fundamental tenets of Marxism with concrete conditions of China,CPC creatively theorized the concept of "New Democratic Revolution".Based on that,CPC constructed the theoretical system of new democratic revolution.Under the guidance of the theoretical system of new democratic revolution,CPC enacted many measures on political,economic,cultural and legal fields.They achieved great achievements.It not only offered the continuous material supply for the wars,but also practiced on the construction of the new-democratic state.More importantly,it gained enormous experience on holding the power.It was the source of confidence for the CPC to run the power nationwide.The systems of politics,economics,culture and law which were set up in Shaanxi-Gansu-Ningxia Border Area became important reference for the systems of New China.The legal system of the People's Republic of China,including system of economic law,followed the legal system in Shaanxi-Gansu-Ningxia Border Area to a large extent.Therefore,it had not only important theoretical value but also important practical value to research on the system of economic law in Shaanxi-Gansu-Ningxia Border Area.The thorough research of national resources of Chinese legal system could provide enlightenment on the problems of system of economic law and other related problems in legal construction.The dissertation is composed of six chapters.The first chapter is the"Introduction".The author starts from the significanceandresearch background of the study.Then she reviews and analyzes the related literature home and abroad.Research thoughts and methods,difficult points and focal points,possible innovations and limitations are discussed.Important concepts are introduced also.Emphasis is placed on the explanation and analysis of current research situations in this chapter,which lays a solid foundation for the dissertation.The second chapter is the "Theoretical origin of the system of economic law of Shaanxi-Gansu-Ningxia Border Area".Systematic review and analysis are conducted on the study of Marx's,Engels',Lenin's,Mao Zedong's and Sun Yat-sen's views on system of economic law.This chapter probes intorelated systems concerning the land problems,financial problems,tax revenue problems enacted during Central Soviet Area period and Kuomintang government period,sorting them out thoroughly.Theoretical background for the creation of the system of economic law of Shaanxi-Gansu-Ningxia Border Area is discussed in this research.The third chapter is the "Land legal system of Shaanxi-Gansu-Ningxia Border Area".Taken the most important land legal system as object of research,the achievements of land legal system of Shaanxi-Gansu-Ningxia Border Area is analyzed from many perspectives,including value orientation,power construction and land conflict resolution perspectives of land legal system of Shaanxi-Gansu-Ningxia Border Area.The author believes,because CPC hasinherited and innovated the Marxist land ownership,making it more suitable for the Chinese practice,it successfully solves the land problem.The land legal system is the crucial problem in winning the revolution.It can get popular support from the vast peasant class,which was the source of conquering all difficulties in the wars and construction.The fourth chapter is the "System of financial law of Shaanxi-Gansu-Ningxia Border Area".Taken the system of financial law of Shaanxi-Gansu-Ningxia Border Area as object of research,the legal process,major characteristics and contents of financial law system are analyzed in this chapter.The author holds the opinion that there are two phases of setting up the system of financial law of Shaanxi-Gansu-Ningxia Border Area,with the South Anhui Incident as a dividing line.There are three characteristics for the system of financial law of Shaanxi-Gansu-Ningxia Border Area:the setting-up of the financial organization and the interaction between the Bureau and civilians;the diversity of financial instruments;and the financial system catering to the industrial policy.Analyses are also conducted on the systems and regulations of banks,currency,foreign exchange,credit cooperatives and gold and silver management.The fifth chapter is the "System of tax revenue law of Shaanxi-Gansu-Ningxia Border Area".Taken the system of tax revenue law of Shaanxi-Gansu-Ningxia Border Area as object of research,overall analysis is conducted from the development of tax revenue of Shaanxi-Gansu-Ningxia Border Area,specific financial laws and evaluation;specific taxes and the overall evaluation of the system of tax revenue law.The sixth chapter is the "Realistic significance of the system of economic law of Shaanxi-Gansu-Ningxia Border Area".Viewing from the theoretical perspective,this chapter starts from the critical analysis of the enlightenment of system of economic law and the guidance of land legal system,financial legal system and tax revenue legal system on the related system construction.In the meantime,objective assessment was carried out to the system of economic law of Shaanxi-Gansu-Ningxia Border Area from political and legal perspective.Lastly,the author makes an objective evaluation of the historical significance of the system of economic law of Shaanxi-Gansu-Ningxia Border Area from political and legal perspectives.Then it draws the conclusion of the dissertation.Firstly,upholding the leadership position of CPC guarantees the success of the revolution and construction of China,no matter in the past wartime or in the present peaceful period.Second,the greatest achievement and most precious experience for the revolution and construction under the leadership of CPC is that to ensure the general interest of the Chinese people.The legislative body should pay more attention to it under the diversified interests of different social classes.Third,adapting Marxism to Chinese conditions is a multiple process.With the firm conviction to the ultimate goal and basic idea of Marxism in China,it is necessary to innovate the line,principles,policies and systems which cater to the social effectiveness.
