Research On The Governance Structure Of Defense Intellectual Property Rights Transaction

In the era of knowledge economy,intellectual property is playing a more and more important role in economic growth and industrial competitiveness.Promoting intellectual property into practical productive forces has become one of the vital tasks to drive economic development.As the achievement of defense technological innovation,defense intellectual property not only can accelerate the speed to change the mode of generating combat capabilities,but also contains huge economic potential.However,there is a certain gap between the transaction rates of defense intellectual property and the demands of economic and social development.Lots of defense intellectual property can be used only once,or even reserved as technology.Innovation driven effect is not obvious at present,China is still in the transitional stage from economic development facilitate innovation speed to innovation facilitate economic growth.Therefore,it is necessary to research how to promote defense intellectual property transaction.Based on the theory of transaction cost economics,this thesis studies how to promote defense intellectual property transaction from the perspective of governance.The purpose of governance is to build an appropriate institutional mechanism to ensure defense intellectual property transaction.The thesis focuses on defense intellectual property transaction,and analyzes the mutual relationship among the people related to transaction,and then constitutes the defense intellectual property transaction governance system.The main contents are as follows.First,the thesis researches the essence of defense intellectual property and its transaction.For the first time,the thesis put forward that national defense intellectual property has capital property,which has the essential characteristics of value preservation and increment.The importance of promoting defense intellectual property transaction lies in the value preservation and increment of defense intellectual property,and then encourages innovation,and ultimately drives economic and social development.The driving function can not only to improve the fighting ability and speed up the transformation of combat power generation mode,but also to drive economic growth.Through quantitative analysis,it can be known that the current driving effect of defense intellectual property transaction is not obvious,thus it is necessary to research on the governance structure of defense intellectual property transaction.Secondly,the thesis researches on defense intellectual property transaction systematically.Promote defense intellectual property transaction is a problem of institutional arrangement in fact.The thesis analyzes the transaction people,transaction relations,transaction status and institutional environment in detail,and puts forward four transaction attributes of defense intellectual property transaction,which are confidentiality,asset specificity,uncertainty and transaction frequency.Confidentiality is the primary attribute which makes defense intellectual property transaction different from other transactions.Finally,the thesis researches four governance structures of defense intellectual property transaction.In order to save transaction costs of defense intellectual property transaction,the core to select governance structure is to match transaction attributes.According to the various attributes of different transactions,the governance structures of defense intellectual property include market governance,hierarchy management,bilateral governance and trilateral governance.All the governance structures constitute the defense intellectual property transaction governance system.Each governance structure coexists with the others,and has its own characteristics.Each governance structure has both its pros and cons,and only when it matches the transaction attributes of defense intellectual property transaction,it is suitable.Through system analysis,the establishment of mathematical model,game model and other methods,the thesis gives some suggestions about how to improve all kinds of governance structure.
