Research On The Intelligence Investigation Of Duty Crime Cases Under The Background Of Big Data

In the era of big data,everything is changing,and the only thing constant is the change itself.The mode of investigation on duty crimes enters a developing track guided by “intelligence” from the “traditional model” and driven by its internal factors and the external environment.The investigation of duty crimes in China also undergoes tremendous changes in aspects of “investigation mechanisms,investigation procedures,investigation cognitions,and investigation techniques”.The integration of big data-related cognition and causal-relation-logic cognition leads the investigation of “intelligence-guided” duty crime cases into a “predictive” era.The “intelligence” in the era of big data guides,dissects and reshapes the investigation model of duty crime cases.In the perspective of big data,this paper comprehensively analyzes and thoroughly studies the investigation of duty crimes “guiding” by intelligence.This article consists of six chapters:Chapter 1 introduces the backgrounds and academic significances of the existed anticorruption work.Through analyzing the work situations and developing trends of intelligenceguided duty crime investigation in China and abroad,this chapter summarizes the evolution of China's duty crime investigation mode.The literature review section systematically introduces global research on related issues.Based on the basis of previous researchers,this chapter proposes the research ideas and research framework of China's duty crime intelligence system.Chapter 2 systematically expounds the connotation and extension of the investigation of duty crime cases and the main characteristics of duty crime cases in China.The concepts of “supervision investigation” and “procuratorial investigation” are also introduced and explained.The necessity of the “intelligence-guided investigation” in an era of big data is analyzed concerning external demand and endogenous drives.Finally,the theoretical basis of intelligence-guided investigation is discussed from the aspects of “model structure”,“causal relationship” and “data-oriented”.Chapter 3 elaborates on the investigation model of traditional duty crimes and proposes four major transforms in the investigation model of duty crimes: the transform of investigation mechanism “supervision investigation” to “prosecutorial investigation”,the transform of investigation techniques from “confession” to “data-based”,the transform of investigation procedure from “post-event investigation” to the “pre-exposure”,and the transform of investigation cognition from “cause and effect” to “relevant”.Chapter 4 is the core part of this paper.This chapter comprehensively introduces the application mode of “intelligence guidance” including the basic data source of duty crime cases.Application of intelligence in clue discovery,crime prevention,guided interrogation,tracing and arrest,special investigation are also included,as well as frequently used techniques such as CDR analysis,trajectory tracking,currency flow,mobile phone data portrait,and association analysis.Chapter 5 develops functional and technical frameworks of the duty crime intelligence information platform,and draws on the setting mode of the off-site duty crime intelligence organization,and proposes the idea founding duty crime intelligence agencies under the unified supervision of the supervisory organs.The security mechanism for the operation of duty crime intelligence information is comprehensively discussed from the aspects of collection,analysis,evaluation,and feedback.Chapter 6 considers the conflicts and balance between the application of duty crime information and the protection of privacy in the context of big data,and analyzes the impacts of the privacy attribute of the big data era and the application of intelligence information on the privacy.This chapter considers the application of big data and privacy protection in China,learns from the foreign legislative models and draws envisions on intelligence-based regulation and privacy protection,aiming at the integration of combating crimes and human right protection.
