With the progress of the times,the development momentum of big data has swept the world in recent years.Big data is widely used in domestic enterprises and the public domain.According to the "China Big Data Development Survey Report(2019)" released by the China Information Research Institute in May 2019,the size of China's big data market in 2019 will reach 106.8 billion yuan,and it is expected that it will maintain a growth rate of more than 40% per year from 2019 to 2022.rate.According to the survey,currently 49.2% of enterprises have set up relevant departments for data analysis.However,big data has just begun to be applied to the field of job crime,especially the job crime investigation department of the procuratorial organs was transferred to the supervisory commission for a short time.At present,the supervisory commissions in some economically developed regions have only just begun to explore and use the original procuratorial organ Big data,but most of the supervisory committees have not really come into contact with the big data field,and we still have a long way to go.This article mainly describes the application method of big data in the investigation of occupational crimes.Based on the current practice of applying big data in some regional disciplinary commissions and supervisory commissions,it summarizes some problems in the current application of big data,and proposes solutions to the existing problems.The Discipline Inspection and Supervision Committee put forward guidance in handling cases.A more complete framework for big data investigation is proposed,including concepts,thinking,patterns,and methods.It also reveals some misunderstandings in the big data boom;emphasizes the prospects for the widespread use of big data-related thinking and predictive thinking in surveys,especially predictiveness,and will surely promote the transformation of post-hoc investigations intopre-investigations and predictive investigations;and propose big data surveys Model,which emphasizes finding breakthroughs from the data space;specific methods for big data surveys such as clue evaluation,bill analysis,bill analysis,electronic data analysis,and association analysis have been developed and applied by practical departments;It is emphasized that while technology and applications of big data investigation are developed,it is necessary to pay attention to the legal issues brought about by them and the impact on traditional legal principles and rules,and to conduct certain procedures and regulations on big data investigation.
