Abstract/Summary:
School can be an unsafe and even dangerous environment for lesbian, gay, bisexual, transgender, and questioning (LGBTQ) students. This work examines a selected review of court cases involving the harassment and/or discrimination of LGBTQ students in public schools. Twenty-one cases were studied, summarized, and analyzed to address the following questions: (a) What types of legal issues are involved in alleged harassment and/or discrimination cases brought by LGBTQ students? (b) What are the legal responsibilities of public school teachers, administrators, and school boards to protect LGBTQ students from harassment and/or discrimination? (c) What is the nature of the alleged harassment and/or discrimination of LGBTQ students? (d) What are the impacts of harassment and/or discrimination on LGBTQ students? After these cases were studied and analyzed, recommendations were made for public school teachers, administrators, and school boards on their legal responsibilities concerning LGBTQ students, as well as recommendations on creating and maintaining safe school climates.
