Research On The Transtration System Of Mineral Resources Property Right In China

The scarcity and allocation of mineral resources have always been concerned by human society.Over the past 40 years of reform and opening up,China has adhered to the path of the socialist market economy.As one of the factors of production,mineral resources have made remarkable achievements in market allocation.In terms of mineral resources transaction,it has gone through the process from free to paid,from administrative allocation of resources to market-leading,and has made great progress in the transaction varieties,transaction scope and other aspects.Because China is in the transition period from Socialist planned economy to Socialist market economy,in order to further strengthen and improve the Socialist market economy system,the mineral resources property rights dominated by state-owned property righs,takes the marketization trading as the direction and goal,so as to realize the optimal allocation of mineral resources.It is of great practical and theoretical significance to study the transaction system of mineral resources property right in China.At present,the mineral resources property rights transaction market is underdeveloped,the construction of the transaction system of mineral resouces property right is not perfect,the macro-control role of the government is not in place in the mineral resources industry,the mineral resources property rights transaction is inefficient,the service transaction system of mineral resources property rights is not sound.Therefore,there are many problems,such as corruption,power-seeking,absence of government supervision,loss of state-owned assets,waste of resources,environmental damage,mass incidents,casualties,and so on.In addition,there is a large gap compared with the market economy of developed countries.China has not established a sound transaction system of mineral resources property rights,which can not achieve rational and optimized allocation of mineral resources.In terms of theoretical research,Chinese scholars focus on the definition and allocation of mineral resource property right,have done relatively little research on the transaction of mineral resources property right,and the depth and breadth of the research are insufficient,lacking comprehensive,systematic and comprehensive research.Firstly,the paper introduces the research background,research significance,concept definition,paper structure,research methods,innovation and shortcomings,and summarizes theoretical basis and research progress.In terms of concept definition,this paper expounds the connotation of property right,property right transaction and mineral resources property right transaction.In terms of theoretical basis,it mainly introduces the property right economic theory and the institutional change theory.Then,starting from the tradability of mineral resources property rights,the paper studies the tradability of mineral resources property rights,the direction and process of institutional change of the transaction system of mineral resources property rights.Based on the tradability of mineral resources property rights,the paper discusses the nontradability of mineral resources property rights under the planned economy system and the tradability of mineral resources property rights under the market economy system.The paper points out the marketization trading direction of the property right transaction of mineral resources in China,and studies the feasibility and inevitability of the marketization trading tendency of the property right transaction,as well as the basic principles of marketization trading.In the aspect of the system change of mineral resources property right transaction,the paper studies the realistic basis of the system change of mineral resources property right transaction,the supply and demand of the system change,and cost-benefit analysis.Thirdly,the direction and institutional change,the paper discusses the subject,object and system of mineral resources property right transaction in China.The paper studies the connotation and characteristics of subject and object of mineral resources property right transaction,and discusses the power and function of mineral resources property right transaction system,analyzes the system of mineral resources property right transaction in China.Fourthly,the paper summarizes the specific system design of mineral paper deeply studies two cases,one is the case of 100 billion mining rights in shaanxi Province,and the other is the pilot reform of oil and gas resources exploration and exploitation in Xinjiang ,and further demonstrates the design of mineral resources property rights transaction system in China,so as to provide the reference and practice foundation for the construction of mineral resources property rights transaction system in China.Combined with current practice,the paper puts forward some policy suggestions on the transaction system of mineral resources property rights in China,including four aspects: constructing the transaction system of mineral resources property right,giving full play to the macro-control role of the government in the mineral resources insdustry,improving the allocation efficiency of mineral resources property rights transaction,and enhancing the service system of mineral resources property rights transaction.Compared with the existing research results,the innovations of the paper mainly show the following four aspects.Firstly,the paper expands the theory of mineral resources property rights.Secondly,it opens up a new perspective on the research of the transaction system of mineral resources property rights dominated by state-owned property righs.Thirdly,it systematically studies the transaction system of mineral resources property rights in China.Fourthly,it puts forward some policy suggestions on the transaction system of mineral resources property rights in China.The transaction system of mineral resources property right involves many problems,and it needs to be further expanded in the following aspects in the future.Firstly,the general theory of the transaction system of mineral resources property rights needs to be studied in depth.Secondly,we should systematically study the transaction system of mineral resources property right.Thirdly,we should carry out a comprehensive study on the transaction system of mineral resources property rights.
