Objective:The building of the Chinese medicine expert inheritance studios(referred to as CMEIS)by the state in 2010 is to carry out the academic thoughts.of famous Chinese medicine practitioners,summarize clinical experience,and promote Chinese medicine.A group of Chinese medicine knowledge inheritance and the innovative elite teams emerged and produced a wealth of knowledge in the past 7 or 8 years.The study on intellectual property management of CMEIS is to promote to carry out knowledge inheritance and innovation in a more legal,standardized,systematic and scientific way,and to maximize the effect of national policies.This paper attempts to study the intellectual property management issues of CMEIS,based on the analysis of the knowledge characteristics of Chinese medicine?the intellectual achievements of CMEIS?the contents and characteristics of intellectual property of CMEIS,and problems of intellectual property management of CMEIS.On the basis of the definition of "system" by Scott---the sociological institutionalism in the new institutional economics,with knowledge inheritance and innovation performance of CMEIS,the model of the intellectual property management of CMEIS is established.This paper empirically analyzes the influencing factors and influencing mechanisms of the intellectual property management system of CMEIS,and builds the intellectual property management system to promote knowledge inheritance and innovative of CMEIS.Specifically,how to break through the existing intellectual property system to establish a complementary intellectual property system in line with the characteristics of TCM knowledge;how to give full play to the performance of intellectual property "assets" for full operation to achieve the optimal allocation of intellectual property,a scarce resource of CMEIS;how to define the intellectual property owner after the role of team situational factors in the construction of tacit knowledge;how to make CMEIS participate in the formulation of international standards and strive for an international voice,and help the internationalization of traditional Chinese medicine and other issues,this paper discusses and puts forward relevant innovative suggestions.Method:This paper mainly used an empirical research method based mainly on questionnaires and in-depth interviews.Through literature review and based on Scott's sociological institutionalism theory,intellectual property management theory,the model of intellectual property management system of CMEIS is constructed.The questionnaire is designed according to the model.After the revision,the pre-survey was carried out,and the shortcomings of the questionnaire were analyzed to form a formal questionnaire.All of CMEIS in the country were investigated.The investigation was launched with the help of the Personnel and Education Department of the State Administration of Traditional Chinese Medicine.After investigation and obtained the data,two master's graduates entered,checked and cleaned separately,eliminated the invalid data,and then used SPSS21.0 software for descriptive statistical analysis and reliability and validity analysis;on this basis,further used AMOS21.0 software to structure the model Equation analysis,testing and correcting the model to verify the rationality of the relevant assumptions.RESULTS:Among all the 17 hypotheses in the initial model,except for"culture-cognitive factors positively affect behavior","regulation positively affects their own performance","regulation positive impacts comparative performance","resource positive impact comparative performance ",the four hypotheses were not supported by the test,and the remaining 13 hypotheses were not rejected.Among them,"normative factors positively affect resources","normative factors positively affect behaviors","cultural-cognitive factors positively affect their own performance",and "normative factors positively influence comparative performance" assumptions were established and path influences coefficient is high with significant impact."Regulatory elements positively affect resources","Regulatory elements positively affect behavior","Cultural-cognitive elements positively affect resources","Regular factors positively affect their own performance","Culture-Cognitive factors positively affect the comparative performance",the software shows to accept above five hypotheses,but because the path coefficient is negative,the one-way positive impact of the original hypothesis still has a discussion space,which is also in line with the theoretical basis of the model construction.Under certain circumstances,the higher and stricter the regulatory elements,the deeper the cultural cognition,the more restrictive the impact on resources,and thus may show the possibility of negative impact.The mediating effect of resources,the mediating effect of behavior,and the mediating effects of resources and behaviors are also significant.Conclusion:Therefore,the promotion of the normative elements of the intellectual property management of CMEIS is conducive to the improvement of the resources of intellectual property management and the behavior of intellectual property management.It can also directly positively affect the performance of knowledge inheritance and innovation through the intermediary role of resources and behaviors.Improving intellectual property management behavior has a direct and significant effect on the improvement of knowledge transmission and innovation performance.Enhancing the regulatory elements of cultural property management and cultural cognition elements may raise resources,but it is necessary to grasp a certain degree,otherwise it will hinder the allocation of resources.
