Research On The Current Situation And Countermeasures Of Chinese Medicine Trademark Protection In Jilin Province

Objective:According to the "Chinese medicine law" and other related to the Chinese medicine intellectual property rights,the protection of chinese medicine trademark historical changes and the relevant policies issued by the state especially,The trademark of traditional chinese medicine was studied and analyzed in jilinprovince,The basic situation and protection of traditional Chinese medicine trademark in jilin province were analyzed,the problems existing in trademark protection of traditional Chinese medicine in jilin province were found out and constructive suggestions and countermeasures were put forward.Finally,according to the existing basic conditions of jilin province in the protection and development of traditional chinese medicine trademarks,efforts are made to explore,put forward relevant opinions and suggestions,and strive to solve the new situation and new problems in the protection of traditional chinese medicine in jilin province.Methods:This paper USES the method of literature analysis,the problems of trademark protection of traditional chinese medicine in jilin province were compared with the whole trademark of traditional Chinese medicine in China and the trademark protection of traditional chinese medicine in some provinces.And compare the successful experience of Europe,America,Japan and other countries and regions with the difference between traditional chinese medicine trademark protection literature,then,relevant research materials and data at home and abroad are classified and summarized,and collected through investigation,expert consultation and other ways,As of 2018,relevant information of trademark registration and protection of traditional chinese medicine in jilin province will be processed and compared with statistical analysis method.Results: This paper mainly based on jilin province,a total of 293 pharmaceutical enterprises were investigated in jilin province,among which 187 enterprises producing traditional chinese medicine products were selected as the key research objects in this paper.Among them,a total of 13 TCM enterprises have certified 14 chinese well-known trademarks in the TCM field.In this study,4425 cases of traditional Chinese medicine trademarks of 187 traditional Chinese medicine enterprises and protection policies of traditional Chinese medicine trademarks in jilin province were investigated.Through analysis,it was found that there were some phenomena such as incomplete policies,weak consciousness,unreasonable design and insufficient publicity.In view of the problems found,this paper puts forward some targeted improvement measures based on the reality of jilin province.Conclusion:As far as TCM itself is concerned,studying the development status and protection of its trademark is an effective means to improve the protection of important intellectual property rights and promote the development of TCM in jilin province.The law on traditional chinese medicine(TCM)was issued in 2017,which mentioned "protecting TCM intellectual property rights and improving TCM science and technology",which will bring greater opportunities and challenges to the future protection and development of TCM trademarks in jilin province.Through investigation and research,it is found that although the development of china'spharmaceutical and health industry has ushered in the spring,jilin province is still facing many problems in the policy,registration,publicity and design for the protection of traditional Chinese medicine trademarks,which has seriously affected the healthy and rapid development of the traditional chinese medicine industry in jilin province.
