More than 30 years of practice has proved that Chinese-foreign cooperation in running schools is an important form and carrier for China to expand the opening of education to the outside world,cultivate high-quality international talents,satisfy the various educational needs of the society,and promote cultural exchanges and mutual learning between China and foreign countries under the concept of a community of shared future for mankind.As an important part of China's education,It has multiple meanings in education,economy,culture,politics and law.In domestic law,as a unique legal concept in the field of education in China,Chinese-foreign cooperation in running schools is Public welfare education and educational organization form.In international law,Chinese-foreign cooperation in running schools is a form of educational service trade in China under the framework of GATS,which belongs to a kind of "commercial presence".The essence of education is a kind of social activity to cultivate people.Quality is the essential requirement of education,Quality assurance is the inevitable path for Chinese-foreign cooperation in running schools to achieve educational objectives and sustainable development.and it is the basis for the sustained and healthy development of Chinese-foreign cooperation in running schools.This paper clarifies the basic concepts,basic theories,basic links and basic legal relations of the quality assurance of Chinese-foreign cooperation in running schools.Through the fog of quality existing in the practice of Chinese-foreign cooperation in running schools,it combs the relevant rules and regulations of international and domestic laws,sums up and explores the mechanism and path of the construction of the legal system for the quality assurance of Chinese-foreign cooperation in running schools.The purpose is to promote China to fully exercise the right of internal regulation of education,actively participate in global education governance,build appropriate institutional mechanisms,Under the premise of safeguarding national sovereignty and educational sovereignty.So as to improve the quality of Chinese-foreign cooperation in running schools,better achieve the goal of training qualified builders and reliable successors for socialism.This paper holds that based on the characteristics of foreign affairs,trade,public welfare and education,the legal system of quality assurance of Chinese-foreign cooperation in running schools must properly handle the relationship between the maintenance of educational sovereignty and the opening of education,the relationship between international rule of law and domestic rule of law,the relationship between public welfare and profit-making,and the relationship between Chinese and foreign quality regulations.It is necessary to follow the principles,concepts and mechanisms of safeguarding educational sovereignty,pacta sunt servanda,balancing public welfare and profit-making,coordinating jurisdiction overlap,and actively participating in global education governance.There are three main links of legal regulation in the quality assurance of Chinese-foreign cooperation in running schools: market access regulation,educational process supervision and quality evaluation and certification.There are three main responsibility subjects: government,universities and evaluation and certification agency.The construction of the legal system of quality assurance of Chinese-foreign cooperation in running schools should focus on the above three main links and three main responsibility subjects.To be specific,it is necessary to form and improve the legal framework and institutional norms for the quality assurance of Chinese-foreign cooperation in running schools in accordance with the separation and coordination of the government's management,the universities' running and the third party's evaluation.It is necessary to establish a classified access system,formulate a catalogue of disciplines and specialties,refine the quality standards for market access,establish a quality early warning mechanism,straighten out the administrative supervision mechanism,strengthen information disclosure,and improve the exit system.It is necessary to explore a diversified way of enrollment by combining unified examination with independent examination in Chinese-foreign cooperation in running schools,establish an improvement mechanism of educational quality evaluation with the participation of multiple subjects,and take the lead in implementing degree classification in Chinese-foreign cooperation in running schools.We should strengthen the legislative supply of evaluation and certification,add relevant provisions on Chinese-foreign cooperation in running schools,introduce relevant supporting systems for evaluation and certification,giving the legal status of the certification of Chinese-foreign cooperation in running schools,and deepen international cooperation in evaluation and certification.At present,the state is carrying out the revision of Regulations and the measures for the implementation of the regulations on Chinese-foreign cooperation in running schools.The author hopes that the new law revision will pay more attention to the quality assurance,amend the relevant laws and add corresponding provisions from the three links of "management,running and evaluation",strengthen quality assurance,so as to make Chinese-foreign cooperation in running schools to be a legal,international,characteristic and high-quality window of education opening to the outside world,and a model of comprehensively managing education by law.
