Crime Prevention Of Juvenile Delinquency From The Perspective Of Criminal Personality Law

Since the 1990 s,the juvenile crime rate in China has been increasing continuously,and the means and nature of the crime have changed,which bring serious challenges to the current prevention system and has become a major concern of the society.Innovation is required both in theory and practice,regarding juvenile delinquency prevention,to change the emphasis from the revenge and retribution functions of penalty to the prevention through education and rescue,and to change from engaging in post-punishment and deterrence to the people-oriented preprevention.Therefore,this discussion aims to explore an effective way preventing juvenile delinquency with the theory of criminal personality law.This study discusses minor crime prevention from the perspectives of criminal personality law.Through innovating personality prevention in environmental prevention,constructing an open prevention system oriented by personality prevention,designing the monitoring index system of ideology and morality for crime prevention,The aim is to explore new ideas of juvenile delinquency prevention,reduce crime rate and social education correction cost,and provide reference for theoretical and practical departments to prevent juvenile delinquency.The contents include: the new characteristics and causes of juvenile delinquency in China and the current situation of prevention;the personality prevention in environmental prevention;the construction of an open prevention system oriented by personality prevention.The new characteristics of juvenile delinquency in China include: the subculture of cybercrime and bad information become the important inducement of juvenile delinquency,organized crime and cybercrime are increasing gradually,the number of crimes committed by minors and left-behind children in rural areas and urban communities has increased,the motives of minor crime are usually simple and the means are cruel,property violations and drug-related cases are on the rise.Reasons for minor crime are are as follows: adverse social environment is easy to induce thought deviation and behavior anomy,traditional family education does not pay enough attention to personality shaping,school education places too much emphasis on grades,regulation of cultural and commercial markets is insufficient,there are difficulties in solving the crime of left-behind children in rural areas,the operation of specialized schools is facing difficulties,and the traditional system and concept of help and education need to be innovated.Current situation of crime prevention in our country is: The preventive effect of network needs to be further improved,family and school prevention haven't paid enough attention to personality shaping,community protection needs to be further improved,psychological prevention has not become the focus of personality prevention,the shaping of minor's moral thinking is weak,The prevention and treatment potential of social groups has not yet been realized.To improve the personality prevention in innovative environmental prevention,the prevention level of network should be improved.Through purifying the network environment and technological innovation,we should scientifically guide minors to use the network reasonably and prevent the adverse network behavior from affecting the personality of minors.Family prevention should emphasize personality prevention,establish a family prevention model with "love" as the core,and pay attention to the impact of family environment on the mental health of minors.Moral education in schools should guide moral education with the essence of Traditional Chinese culture and socialist core values,and emphasize the shaping of healthy personality.The community should optimize the function and environmental conditions and innovate the community education and help model.In rural areas,it is necessary to strengthen the prevention and treatment of crimes committed by left-behind children,attach importance to the psychological health of left-behind children,establish a compulsory guardianship system,and improve the effective mechanism of rural social assistance.The new ideas for the construction of an open prevention system oriented by personality prevention are as follows.We should actively prevent juveniles from forming criminal psychology in the process of socialization,strengthen the psychological guidance of juveniles in social communication,help juveniles to establish correct moral outlook,scientifically use "cognitive therapy" for education and correction,and create good environmental conditions to promote the mental health of juveniles.Biological treatment is a new approach to the prevention and treatment of juvenile delinquency,and personality investigation is the premise and foundation of biological treatment,so the level of biological prevention should be improved with new technical means.The cultivation of moral thinking ability is the core of moral education,which should be integrated into "love education","equality education" and "independent education".The monitoring of criminal thought and morality is helpful to prevent and control moral deviation in time,so we should construct the index system of monitoring criminal thought and morality.We should innovate the comprehensive prevention system for juvenile delinquency,attach importance to the role of sports intervention,give play to the prevention potential of social groups and improve their self-prevention ability.
