The system of investigation of personality is a system of criminal judicial proceedings.During the criminal judicial proceedings, it aims to choose to a proper extent of treatment methods for every crime person with a full investigation of situation、background and life,and before the judgment the court can make a scientific analysis and identification according to investigation。 In many countries and regions in the world this system have been clearly established, and have been perfecter and maturer gradually.In foreign countries, this system has been widely applied to juvenile and adult criminal cases, and throughout the whole process of criminal judicial proceedings in the field of criminal justice.However,in China, the legislation of this system is few, and in the existing legislation, it only regulate the social investigation of juvenile criminal;Also, the works about this system from the scholars is very few, and in the existing works,they are only suitable for the conviction and sentence and the juvenile criminal cases. This leads to the seemingly "gorgeous" system in China is still only on paper, and it is unable to realize the value of its system.Whether in the academic schlli or the practical school,the research on this system is not deep, and there are many different opinions about this system in our country at present, so it is still in the exploratory stage.And with the development of criminal legislation and criminal justice system more humane, the investigation of criminal personality is particularly important in the criminal proceedings.Obviously, a pressing matter of the moment is to improve the procedure of criminal judicial action in China by buildding a unified system which belongs to the personality survey system, and constructing the mature personality survey system.Finally, the investigation of personality before sentence will become China’s formal legal system.
