| Supporting social control by moralizing and modeling citizens is the most important function of modern university.To realize this function,university needs legislation and enforcement of the internal regulations to organize the everyday life openly,expressly and steadily.Among these regulations,some are about the students’ affairs and academic guidelines,which can be named as the Campus Regulations.The Campus Regulations are made by the government or the universities,which regulate the rights and duties,restrict the behaviors and ideas by compulsion and apply among the students.As these regulations will influence and impact the behaviors,attitudes and sense of worth of the students concretely and directly,they can rule,control and model people,so we can talk them as Law in organizations.In this sense,the Campus Regulations and regulations-abiding correspond to the topic in jurisprudence: Law and Law Abiding.The aim of this thesis is to prove the possibility and the ways of internal regulations in cultural communities can support the social control.At the same time,with the perspective of specific experiences,this thesis also talks about the relationship between legitimacy of regulations and the abiding of people.In order to achieve the aim,this thesis is based on the field work in S University,a typical Chinese university.The everyday life in S University constitutes the research backgrounds.In this small place,we can talk about the great issue: Law and Law Abiding with case-extended research method and process-event analysis.The local knowledge theory,the social control theory and the communication action theory are the main theories that are used to explore the interactive relationship between the regulations and the addressees.This thesis contains 4 main parts.In chapter 1,it discusses the regulation-dimension of the Campus Regulations with a static view.It perceives the Campus Regulations as a kind of internal law in the community,which has the characteristics of local knowledge.Compared with other social norms,Campus Regulations are mainly manifested in indirectly leading social life by shaping educated people,and the way is to diffuse the advocacy and promotion of ‘good virtue’ in the normative text.And in the process of application,the Manipulators emphasize the reasoning and persuasion of the Campus Regulations.Chapter 2 does a dynamic analysis on the Discipline,which is about the functions of the Campus Regulations.The regulations construct the background of the everyday life by defining the members of the school in the three dimensions of time,space,and content,thus affecting how the Addressees choose to act and designing their life trajectory;At the same time,through a set of training mechanisms combining‘prize-penalty dualism’ and ‘metaphor-enculturation’,the Campus Regulations act on the concepts and actions of students,so as to achieve the ‘external-internal’ double discipline.In this way,the effects of order,harmony and education are exerted.Chapter 3 analyzes the complex operating environment of the Campus Regulations.It is believed that the Campus Regulations operate in complex community life,which may lead to some alternative results.Describing the alternative actions of the Manipulators of Campus Regulations and the reverse resistance of the Addressees of Campus Regulations to explain that the Campus Regulations do not only operate spontaneously from text to action,but are the result of the interaction between the Manipulators and the Addressees in a specific social and cultural context.Chapter 4 talks about the cultural significance of the Good Operation of Campus Regulations.It gives an overview of the limitations of the Campus Regulations,and discusses the non-attributive and non-closed nature of the effectiveness of Campus Regulations.It is believed that the benign operation of the Campus Regulations depends on the excellent campus cultural environment.The ‘multi-layer superposition’ effect played by excellent campus culture can bridge the limitations of the Campus Regulations,maintain the benign operation of the Campus Regulations,and enable the educated to experience the ‘rule of rules’ that the Campus Regulations continue to legalize.Participate in cultural communication in daily life,and in the specific‘process-events’ applicable to the Campus Regulations recognize,understand,perfect,and abide by the rules based on the identity of the subject and the internal point of view,so as to obtain a more smoothly socialized empowerment.Therefore,the cultural significance of the benign operation of the Campus Regulations lies in the formation of suitable social subjects with procedural guidelines,and the support of social control in the form of internalization of regulations and externalization of efficiencies.Research results show that abiding the Campus Regulations is not the instinct,nor the innocence of students,which is not the result of the severe regulations neither.Students can abide the Campus Regulations when they are disciplined by the regulations in the everyday life through the declaring,performing,applying of regulations and settling the disputes.In this process,the students can recognize,abide and maintain the Campus Regulations,at the same time,the order in the university can be built.With the discipline,the students may develop the consciousness of law abiding and leading the fashion of the society.Furthermore,the discipline in university has sociocultural significance: providing students opportunities and channels to participate in the creation and improvement of regulations.In this process,they may develop a sense of subject consciousness and a tendency of abiding the law,so that they can successfully integrate into the ‘co-construction and sharing of governance’ after graduation.My study proves that the interaction isomorphism between ‘legitimacy’ and‘law-abiding possibility’ can be based on the dual practice of ‘endogenous development’ of rules and ‘subjectivity development’ of the people.And the sociability and mobility of university education provide a concrete channel for this practice.The conclusions show that the operation of the Campus Regulations carries the Process Discipline to the educatees,the Process Discipline can experiment with the benign interaction of law and law abiding,and the benign interaction between law and law abiding can enhance the participation of educatees in the social governance practice of ‘co-construction,co-governance and sharing’.In a word,the effect of education can be transferred to the general social life,so the regulation and discipline in university’s everyday life can cultivate eligible,qualified and regular social man,who may lead the fashion of Law-abiding... |
