Water resources are the basic natural resources and strategic economic resources. Water resources are the essential and irreplaceable important matter of economic growth, social stability and the people's life, and are the significant guarantee of economy and society sustainable development. Meanwhile, we should see that the water resources are at the edge of being dried up. as it has been overused for years. Therefore, many countries in the world and international organizations adopt the legal means to protect and manage the water resources. With the constant development of the economy and the society, reasonable development utilization of the water resources, especially the protection and management of water resources in accordance with the law, how to keep water ecological balance to ensure that water resource would be enough for human beings forever has already become a great subject for sustainable development in our country. The sustainable utilization of the water resource has become the foundational, overall and strategic problem of sustainable economic and social development.As a developing country, China has carried out a policy which regarded water resource as valueless thing. This policy arose many problems such as abuse and waste, and its affection still exists today. The national water resource condition is not optimistic, with deteriorating water quality, worse water condition, and lots of water pollution accidents. On the other hand, low water utilization efficiency and serious waste of water aggravate water resource shortage. In order to regulate the development and utilization of water resources, and keep the balance of water ecological system, we must construct a set of scientific and reasonable system of water resources sustainable utilization legal system. But China's current legal system about the provisions of the water resources sustainable utilization problems is still imperfect. So we have to found a series of legal system to adjust this.Five common chapters are composed of the main body of the thesis. The preface part introduces the background, the purpose and meanings, state of study aboard, and the methods of the dissertation. The second chapter sets off from our country's water resource current situation, and emphasizes to realize the significance of water resources sustainable utilization; By comprehensively introducing the connotation and essence of sustainable development theory, the third chapter analyzes the relationship between the sustainable development and water resources, and clarifies the sustainable utilization of water resources as the important content of economic and social development, and concludes that adhering to the sustainable utilization road is the inevitable choice of history. By analyzing and comparing the foreign legal system of water resources' sustainable utilization, the fourth chapter absorbs the reasonable part and provides the references for China's water resources' sustainable utilization system. As the core of the article, by introducing the latest research achievement of water right system, the fifth chapter analyzes and evaluates the legislation subject and thought, system design and specific contents, and puts forward that we should construct China's sustainable utilization of water resources system. Guided by the sustainable development thought, we should further improve the laws and regulations of water resources, establish a clear watershed management system and water right system, establish public participation mechanism to provide reliable legal protection for achieving sustainable utilization.In short, China's water resources sustainable utilization must take the ideas of sustainable development as the instruction, and explore the legal system of water resources sustainable utilization on level of legislation, so that we can eventually realize the coordinated development between the economy, resources and environment.
