Several Thoughts On China's Environmental Legislation

Over a long period of time, economic development has become the utmost concern of almost every country. Economic gain has grown up to be the first goal that each country seeks. Consequently, not enough attention was paid to the environment protection. The fact has testified that only positively confronting and properly tackling environmental protection is social economy able to obtain sustainable development. Moreover, a wealthy and sustainable economy can become possible only within the scope of environment self-purification capacity and carrying capacity. This needs an effective cooperative mechanism to be established between countries around the world on the environmental protection issue. However, this relies on the common ground possessed between them. The birth of this common ground has to for one thing refer to the common experience and lessons during the course of creation of human civilization; and for another, countries should consider other countries realistic situations. Besides, each country should recognize each own real conditions, face the exiting problems and fully explore its own resource advantages. The author of the paper believes that international cooperation can be safeguarded by making law. Likewise, only by means of making law can environment protection problem of one country be solved.By analyzing the existing problems and deficiencies of environmental legislature in our country and positively borrowing legislating ideas, learning experience and lessons of advanced countries, the thesis, based on our country's realistic situations, makes an attempt to propose some constructive ideas with regard to environmental legislation. That is to say, how China should perfect its environmental legislation so that it can lead to harmonious relationship between economic growth and environmental legislation, and sustainable development based on its practical condition. Thus an agreeable society can be realized.To this end, such methods as comparative analysis, value analysis and empirical research have been adopted. All these methods are taken to describe and explain the problems in environmental legislation. And on the basis of this, many effective means have been advanced to tackle them. The author holds that in the course of legislating, it is of great need for us to respect objective regulations, amend and perfect the present environment law under the guidance of scientific development view, to change the situations in which laws our made out of authorities at various levels; to fill in the legislation gap; to improve the legislation skills; to detail the rules and regulations; to strengthen the democracy of legislation and to perfect the procedure of legislation. All the efforts are made for the environment protection issue so as to leave a blue sky for our descendants.
