On The Perfection Of China's Environmental Legislation

The People's Republic of China Environmental Protection Law has promulgated since 1989, China has witnessed tremendous socio-economic changes. With the rapid development of economic construction, environment is constantly being destroyed, new environment problems is springing up. Although the environmental protection has reinforced in recent years, but environmental pollution and ecological destruction is still a conspicuous phenomenon, environment problem becomes a serious issue gradually. Under the inspirit of ruling by law and building a socialism country of ruling by law, "The People's Republic of China Environmental Protection Law" and relative laws in the fields of environment and resource protection, are facing theoretical and practical pressure , the existing environmental legislation no longer adapt the practical needs of economic development and environmental protection. Changes in environmental social relations called for amendment on "Environmental Protection Law" ,also called for the further improvement of environmental legislation, which is the needs of China's economic development and people's lives, as well as the need to meet the international standards.Since branch of environmental law has emerged , the scholars gave a great deal of attentions. Our country environmental laws appeared at a later stage, environment legislation have not transformed, pollution control law is still the core of the traditional system of environmental law, and the use of traditional means of protecting the environment law has shown tremendous limitations, therefore, we need change our thinking and concepts, and gradually improve China's environmental legislation from some new theory.This paper reviews the history of environment law in China, and analyses the efects of the existing environmental laws from a historical perspective and the empirical method. we will improve the existing environmental legislation through the guiding ideology, because economic adjustment mechanisms will be introduced into environmental legislation, the role of the market mechanism will be strengthen, we will make up the environment and resources of the market system of law , and we will improve environmental resources system of property rights by the guide of the idea of sustainable development and the guidance of scientific development ,and the market mechanism can form a reasonable incentives on people's behavior, The transformation of government functions further improve environmental legislation, guide people to rationally develop , protect ,make use of the limited resources and the environment, thereby we will establish a society of harmonious coexistence, benign cycle, and comprehensive development and sustained prosperity as the basic purpose of the ecological civilized society between human and nature, human and human, human and society.
