With the prosperity of our nation's economy,more and more vessels need to be put into operation.China has always been facing the risk of vessel-source pollution accidents.The damages resulted from vessel-source pollution accidents are usually serious and difficult to remove.A professional Investigation And Manipulation Mechanism for Vessel-Source Pollution Accidents can not only eliminate the hazards caused by the incidents as much as possible,but also urge relevant authorities to learn lessons from the accidents,improve their investigation mechanism,and achieve the goal of preventing future accidents by punishing responsible parties.China is a country ruled by law, a Vessel-Source Pollution Accident Investigation And Manipulation Mechanism is based on a serious of legal and regulatory authorizations.Using legal means to regulate the investigation and manipulation for vessel-source pollution accidents can bring about good results.China has enacted a serious of laws and regulations to govern the vessel-source pollution accident investigation and manipulation mechanism,for example,Marine Environment Protection Law of the People's Republic of China, Regulations of the People's Republic of China on the Prevention and Control of Vessel-Induced Marine Environment Pollution, Provisions of the People's Republic of China on the Prevention and Control of Vessel Pollution of the Inland Water Environment,_Provisions for Management of Maritime Investigators,,Provisions of the People's Republic of China on Marine and Maritime Administrative Punishment, and Provisions on the Administration of Emergency Preparedness And Response on Vessel-Induced Marine Environment Pollution,which shall come into effect soon.Despite the rules,China's legislation in this area is still incomplete,there are deficiencies in the current vessel-source pollution accident investigation and manipulation legal system,all these have led to a disagreement over the purpose of the vessel-source pollution accident investigation and manipulation,and there's even a legal vaccum within the investigation and manipulation system.This article starts from the legal nature of the investigation and manipulation for vessel-source pollution accidents,then refers to the related mechanisms in foreign developed countries.Taking into account the current legislation and enforcement situation of China,and analyze the mechanism according to the general theory of administrative law, in order to identify the deficiencies in the vessel-source pollution accident investigation and manipulation mechanism. Finally, some personal suggestions are made.
