A Comparative Study Of Sino - Russian Environmental Protection Law

People’s Republic of China and Russian Federation are both faced with a variety of environmental problems, therefore these two great countries are active in taking legal measures in order to control environmental pollution and devastation.Using the method of comparison, this study examines Russian Federal Law "On Environmental Protection" and China’s "Environmental Protection Law". As Russian Federal Law "On Environmental Protection" has been developed later in 21st century, therefore basic concepts of law, basic principles, environmental protection requirements and other specific environmental regulations can have a great impact for perfection of Chinese environmental regulations, thus this study provide with suggestions for further development of China’s "Environmental Protection Law".This article begins with the analyze of historical development of Russian Federal Law "On Environmental Protection" and China’s "Environmental Protection Law". In the main chapter the study uses 7 major aspects for detailed description and comparison of Chinese and Russian Environmental Protection Law, these major aspects are the legislative history background, basic framework of the law, the purpose of the law, basic principles of law, legal systems and related legal liability and disputes. Through the detailed comparison of both nations’relative environmental laws, differences and similarities have been systematically analyzed. Finally, by drawing on Russian Federal Law "On Environmental Protection" useful experience and with comprehension to Chinese actual environmental situation, this article propose refereeing comments and suggestions for future revision of China’s "Environmental Protection Law".During the comparison, I have noticed that Chinese and Russian environmental legislation have a lot in common, and they both created some similar environmental legal systems, for example, pollution levy system and environmental effect evaluation system. Though, there are a lot of differences between the two countries environmental laws. The main difference that Russian environmental law is more detail-oriented and much easier to enforce, content of law is more innovative as well. This article focuses on using the experience of Russian Federation in the environmental legal field in order to improve China’s "Environmental Protection Law", so that environmental protection work could be implemented more efficiently.
