Research On The Current Situation,Problems And Countermeasures Of Environmental Protection Courts In China

The Environmental Protection Court is a trial organization set up to deal with environmental pollution,environmental protection and other environmental cases.The construction of Environmental Court in China began in 2007.The Environmental Protection Court of Qingzhen City,Guizhou Province is the first environmental protection court established in China.In 2014,the Supreme people's Court of our country set up the Environmental and Resources trial Court.With the establishment of the Environmental Protection Court of the Supreme people's Court.The construction of environmental courts in China has been developed rapidly.In the process of the development of environmental courts,there are many innovative systems,such as "the combination of multiple trials" and "ecological restoration system".But there are many problems.This paper will be based on the environmental court.Combined with the current situation and trend of setting up the environmental protection court,this paper analyzes the problems of our country's environmental protection court,and puts forward the suggestion of perfecting our country's environmental protection court in combination with the foreign environmental protection court system.This paper is divided into four parts.The summary of environmental protection court.From the beginning of clarifying the connotation of environmental protection court,this paper summarizes the three characteristics of environmental protection court-"trial and environmental protection purpose coexist,professional strong,comprehensive strong".The function of environmental protection court to environmental protection in China is analyzed.The current situation and comparison of environmental courts at home and abroad.Environmental courts in New South Wales,Vermont Environmental Court,Sweden Environmental Court and India Green Court as samples.Compared with the construction of environmental courts in China,the similarities and differences of environmental courts at home and abroad are summarized.The problems existing in the operation of environmental protection courts in China.Combined with the second part "the current situation of environmental protection courts in China",it is concluded that there is a "low rate of cases accepted by environmental courts" in China's environmental courts.The problems of "slow progress of environmental public interest litigation" and "lack of specialized environmental adjudication capacity".In view of the problems existing in the operation of environmental protection courts in China and the experience in the construction of foreign environmental protection courts,the author puts forward "reasonable setting up and broadening jurisdiction"."promoting the development of environmental public interest litigation" and"strengthening specialized environmental judgment ability" are three countermeasures.
