Study On Legal Coordination Mechanism Of Air Pollution Control In Beijing And Its Surrounding Provinces

The atmosphere is an important part of the environment, it is the foundation of human’s existence. Every day we breathe in order to keep our lives, the oxygen rich,clean air is important guarantee to maintain the health of our body.The difference between atmosphere and other natural resources is that it has very strong liquidity and no controllability. With the development of the society, human being create a great amount of fossil energy.Which Has been far more than the air purification capacity,causing serious air pollution.Once the world shocked by the 1943 Los Angeles’ s photochemical smog events,more than Two million and five hundred thousand cars in the city are located in the west coast of the United States, the high streets and back lanes in Los Angeles city every day, the hydrocarbons of automobile emissions makes chemical action with the solar ultraviolet radiation, the city was shrouded in light blue smoke, most people suffered from headache and eye disease. Another example of the London smog incident occurred in 1952, just in five days, more than 4000 people died, after two months more than 8000 people died. These shocking cases staged in the process of human development in the economy again and again, it is enough to cause our vigilance and reflection.2016 is the first year of the 13 th Five-year Plan, adhering to the "innovation,harmony, green, open and sharing" concept of the development, protecting the environment, building a beautiful country are important measures to improve China’s social development and people’s livelihood. Only to protect the environment, can we effectively promote the well-being of the people, let people feel the quality of life of the green mountains and rivers; only to make the environmental protection incorporated into the legal track can the government forms long-term mechanism, the fog and haze can be permanently dispersed; only around the linkage to form resultant force with coordinated operation, in order to fundamentally reduce and to prevent the occurrence of air pollution.This paper is divided into five chapters, the first chapter "Beijing and the surrounding areas of air pollution control law coordination mechanism" mainly introduces the concept and characteristics of air pollution coordination mechanism,and from the theoretical basis and practical basis to explain the Beijing and surrounding areas of air pollution control laws and coordination mechanism of the necessity and feasibility. The second chapter "the current situation of the legal coordination mechanism of air pollution control in Beijing and the surrounding provinces", from the legislative, law enforcement and judicial three levels in Beijing and the surrounding provinces and cities to introduce and analyze the legal coordination mechanism of air pollution control. The third chapter "the problem of the legal coordination mechanism of air pollution control in Beijing and the surrounding provinces" mainly points out the dilemma of the government game,The provisions of the participated main body is not clear, the lack of stability, long-term cross regional environmental regulatory cooperation mechanism, the public participation mechanism is not perfect, and the coordination mechanism is not strong and the public interest litigation system is not perfect and so on.The fourth chapter is "the experience andEnlightenment of the coordination of air pollution control in some developed countries," the experience of the United States, the European Union and Canada. The fifth chapter "Beijing and the surrounding areas of air pollution control of the legal coordination mechanism" through the analysis of the above experiences, improving the air pollution control and coordination mechanism of the main countermeasures and suggestions, the first one is to improve the atmospheric legislation, including the legislative body, the legislative process, legislative content and strengthen environmental ecological compensation system. The second one is to improve the system of law enforcement, mainly through the coordination of the work mechanism,the establishment of government environmental protection performance evaluation system, improve the protection measures to coordinate the Beijing and the surrounding areas of air pollution control law enforcement system. The third one is to establish environmental protection tribunal for atmospheric pollution and construct well-established public interest litigation system to improve the Beijing and the surrounding areas of air pollution control judicial coordination system.
