Study On The Legal System Of Pollution Control In Industrial Parks

Nowadays, environmental protection and cyclic utilization of resources are two main issues that have drawn the attention from the entire world. Human beings are facing with the bad effects that are caused by the over-exploitation of natural resources and environmental disruption in order to seek for maximized benefits all the time, as a result, the deterioration of resource and environment has threatened our survival gradually. Increasing number of governments and scholars start to think how to keep the balance between environmental protection, resource utilization and economic development.After the reform and opening up in China, the economy in China develops rapidly and a large number of industrial zones are established successively, and numerous enterprises and complementary enterprises in the industry have been introduced into China, so as to make full use of their advantages and start centralized production. Yuxi industrial zone try to develop a new mode for economic development in China based on the advantages of environmental resources in Yunnan, that is, spare no efforts to develop economy under the precondition of protecting ecological environment and insists on the strategy to keep balance between the industrial development and environmental protection. The secretary of the municipal committee says "we won’t seek for the short-term economic development at the cost of environment." As long as we stress on the importance of "greening" and "environmental protection", can we establish the idea that the protection of ecological environment that indicates the improvement of ecological environment and the development of productivity and it is the way for promoting green development, circular economy and low-carbon development. In recent years,10 industrial zones have been established in the entire city, the industrial structures of these industrial zones are backward, and these industrial zones adopt extensive management. Although these industrial zones have made certain contributions to local economic development, the environment nearby Yuxi industrial zone has been affected significantly. The serious environmental pollution has become a serious threat to the life and production safety of the surrounding residents.Therefore, the environmental protection and industrial pollution control in Yuxi industrial zone are taken as the research objects in this paper, and it studies the issue of pollution control from the perspective of legal system, which has great realistic significance. At this stage, the scholars at home and abroad already made many analyses and researchers regarding to environmental protection and industrial pollution control. Besides, most scholars in this field are scholars in the field of science, so they mainly focus on the study of natural science. Thus, most of them focus on the control of water pollution when they are analyzing and investigating the industrial pollution control in Yuxi industrial zone, and hardly any scholars study the industrial pollution in this area. Moreover, most scholars mainly focus on study about the techniques in pollution control, and few of them carried out analysis and research on legal systems.As environmental issues have drawn increasing attention from the public in recent years, relevant legislations have been improved gradually. However, some legal systems or relevant principles about the source pollution that are related to industrial zones, which are too abstract and lack of practical operability, or only limited on basic technical standard and pollution emission, as it belongs to the end control of pollution discharge, while the counter measures for the end control of source pollution in industrial zone must be taken because of the intermittence, regionalism and universality, so existing laws and regulations are not so effective for the prevention of source pollution in industrial zones.The author believes China can carry out the management of source pollution in industrial zone according to the actual situation in Yuxi Industrial zone based on the legislation and practice abroad. Firstly, the prevention mode changes from "end control" to "source control". It encourages clean production and release regulations about ecological management in industrial production to promote the activeness of the green producers; establish the system to inspect industrial source pollution, test the industrial source pollution scientifically, and assist the department of administrative management for the management and supervision of pollution. Besides, scientific laws and regulations must be made, so as to ensure the environmental interests of the local residents from the perspective of legislation, to enhance the intensity of law enforcement and to improve the law enforcement mechanism. Secondly, it is very important to improve the justice policy and enhance the punishment on enterprises that violate the regulations continuously, so as to implement the justice policy in real. Above all, the actual situation of Yuxi industrial zone shall be considered in the process of making legal systems and implementing pollution control, so as to ensure its effectiveness and scientificity in making legal measures.
